Chap. 419.—An ACT to authorize the counties of Washington and
Russell to take stock in the Washington and Russell turnpike com-
pany, and to erect telephone lines in said counties.
Approved March 6, 1886.
Be it enacted by the general assembly of Virginia, That
thie board of supervisors of the county of Washington, be and
are hereby authorized and empowered to subscribe to the capi-
tal stock of the Washington and Russell turnpike company, a
sum not exceeding five thousand dollars; and that the board of
supervisors of the county of Russell, be and are hereby author-
ized and empowered to subscribe to the capital stock of said
company, a sum not exceeding three thousand dollars, and for
which subscription stock shall be issued to the county or coun-
ties so subscribing, upon the same terms, and in the same pro-
portion, as to the original stockholders in the present company,
said subscriptions to be in multiples of the value of the shares
as prescribed in the charter of said company, which subscrip-
tions shall be used in macadamizing said road: provided, that
the subscriptions made by the board of supervisors of either of
said counties shall be authorized by a majority of the members
of the board of supervisors of the county making the subscrip-
tion: and provided further, that the order making the subscrip-
tion shall show that a majority of the board of supervisors of
the county making said subscription voted in favor of such sub-
scription. The board of supervisors of either county making
such subscription shall, at any legal meeting of such board, ap-
point three proxies, to’ serve for one year, to represent such
county in all meetings of the stockholders of said company;
and such board making such subscription shall provide for the
payment thereof, by levying a tax sufficient to pay the same.
2. The board of supervisors of Washington and Russell
counties, shall have no power under this act, unless and until
the county court of said counties shall order an election to be
held in said counties, to take the sense of the qualified voters
on the question of making such subscription. Said order of
election and other proceedings to conform in all respects to the
requirements of section sixty-two, chapter sixty-one, of Code
of eighteen hundred and seventy-three, providing the manner
by which counties, cities and.towns may subscribe to works of
internal improvement: provided further, that all the require-
ments of sections sixty-three, sixty- -four, sixty-five, sixty-six
and sixty-seven, of said chapter sixty-one, Code of eighteen
hundred and seventy-three, shall be complied with before any
such subscription, made to the Washington and Russell turn-
pike company, shall be valid or binding.
3. That section second of an act authorizing the Washington
and Russell turnpike company to macadamize portions of its
road, approved March the nineteenth, eighteen hundred and
eighty-four, be and the same is hereby repealed.
4. This act shall be in force from its passage.
