Chap. 386.—An ACT for the relief of Thomas Spencer, administrator
of E. W. Couch, late treasurer of Petersburg.
Approved March 3, 1886.
Whereas at the time of the failure of the Planters and Me-
chanics bank, in May, one thousand eight hundred and eighty-
four, there was on deposit in said bank to the credit of Emmett
W. Couch. late treasurer of Petersburg city, as treasurer for
the state, the sum of eleven hundred and ninety dollars and
one cent; said sum being part of the collections made on ac.
count of the state during the month in which said _ bank failed,
and the time for paying it into the state treasury had not ar-
rived when the said bank failed ; and whereas all claims of the
state against the estate of the said Couch have been settled by
his administrators in full; and whereas there remain yet unpaid
by said bank upon said deposit, the sum of eight hundred and
sixty-eight dollars and seventy-one cents, and it seems unjust
that the loss should fall upon the estate of the said Couch;
therefore,
1. Be it enacted by the general assembly of Virginia, That
the auditor of public accounts be and he is hereby authorized
and instructed to draw his warrant upon the treasurer for the
sum of eight hundred and sixty-eight dollars and seventy-one
cents, in favor of Thomas Spencer, administratoriof Emmett W.
Couch, late treasurer of Petersburg city; provided, that the
auditor shall not draw said warrant until the said administrator
shall excute and deliver to him an assignment of all dividends
hereafter to be declared on the aforesaid deposit, by the bank
aforesaid, |
2. Be it further enacted that the auditor of public accounts
be and he is hereby authorized and instructed to draw his war-
rant upon the treasurer for the sum of one hundred and twenty-
one dollars and fory-nine cents, in favor of Thomas Spencer,
administrator of Emmett W. Couch, late treasurer of Peters-
burg city, being amount of two judgments of the United States
circuit court entered against and paid’ by said administrator in
the cases of D. B. Tennant, and D. B. Tennant andecompany,
in which said Couch had declined to receive coupons in pay-
ment of taxes.
3. This act shall be in force from its passage.
