Chap. 350.—An ACT to allow the Atlantic and Danville railway com-
pany credit ‘for the amount already paid as a tax on its mortgage
recorded, as to part of the line, in the payment of the tax on a
mortgage as to the whole line.
Approved March 1, 1886.
Whereas, the Atlantic and Danville railway company has éx-
ecuted and recorded a mortgage on its line of railway, and has
paid the tax on the same on the line already constructed and in
operation from Claremont to Hicksford; and for the purpose of
continuing the construction of said road to the city of Danville,
the said company desires to substitute therefor a mortgage to
cover the whole line of railway of the said company, from its
eastern terminus to Danville; therefore, .
1. Be it enacted by the general assembly of Virginia, That
if the said Atlantic and Danville railway company shall cause
the present mortgage on its line, in which John B. Whitehead
and William H. Turner are named as trustees, and which was
first admitted to record in the county of Sussex, to be released
and cancelled, and shall make and substitute a new mortgage
in lieu thereof to cover the whole of the line, from its eastern
terminus to Danville, then the clerk of the county or corpora-
tion court in which the said mortgage shall be offered to be re-
corded, shall admit such new mortgage to record, upon the pay-
ments by the said company of the tax required by law on the
whole of the amount secured thereby, less the sum of four hun-
dred and forty dollars, heretofore paid by the said company on
its present mortgage, for which it shall be allowed credit in the
payment of the tax on such new mortgage.
2. This act shall be in force from its passage.
