CHAP. 335.—An ACT for the relief of H.S. Bowen and others, sureties
of John Thompson, deceased, late treasurer of Tazewell county. .
Approved March 1, 1886.
Whereas by an act of the general assembly, approved No-
vember ‘twenty-fifth, eighteen hundred and eighty-four, the
auditor of public accounts was authorized to accept from H. S.
Bowen, and other sureties of John Thompson, deceased, late
sheriff of Tazewell county, certain bonds of the state of Vir-
ginia therein mentioned, in liquidation of the balance due on a
judgment in favor of the state against John Thompson and his
sureties, and which is also in said act mentioned; and whereas
H. S. Bowen, one of said sureties, on the twenty-first day of
November, eighteen hundred and eighty-five, paid to the audi-
tor of public accounts the bonds required to-be paid by said
act; and whereas the said bonds, with all coupons attached, were
turned over to and cancelled by the board of sinking fund com-
missioners, as shown by the records of said board; and whereas
by after-discovered evidence it has been made conclusively to
appear that there was in fact nothing due to the state on the
said judgment: therefore,
1. Be it enacted by the general assembly of Virginia, That
the auditor of public accounts be and he is hereby authorized
to draw his warrant upon the treasurer in-avor of H. S. Bowen,
payable out of any funds not otherwise appropriated, for the
sum of one thousand two hundred and eighty dollars and fifteen
cents, this sum being the actual cash market value paid by said
Bowen for said state bonds so paid in and cancelled as aforesaid.
2. This act shall be in force from its passage.
