Chap. 204.—An ACT to authorize the town of Warrenton to erect
water-works, and to borrow money therefor.
Approved February 24, 1886.
1. Be it enacted by the general assembly of Virginia, That
it shall be lawful for the town of Warrenton, Fauquier county,
Virginia, to provide for supplying said town and the inhabit-
ants thereof with a suitable and adequate supply of water, to
purchase land necessary for the erection of water-works, and
all other powers to exercise which may be necessary to the
completion of said work, and to that end to borrow money and
issue and negotiate the bonds of said town for the same to the
extent of fifteen thousand dollars.
2. Said bonds shall be known and designated as Warrenton
water-bonds, and. shall be issued in such denominations and
bear such rate of interest, not exceeding six per centum per
annum, as may be determined by the council of said town.
The principal of said bonds shall be payable fifteen years after
the first day of January, eighteen hundred and eighty-six, or
upon the call of said town at any time after five years from
said date, and the interest shall be payable annually. They
shall have the corporate seal of said town, shall be signed by
the mayor and countersigned by the recorder thereof, and
shall have printed on the face or back thereof, that they are
issued pursuant to the provisions of this act. Said bonds shall
be negotiated or sold in such manner as may be prescribed by
said council, but not at less than par, nor for any greater
amount than may be necessary for the purpose aforesaid.
3. The control and management of said water-works shall
be under the direction of said council, to be exercised by itself
or through such committees or agencies as it may adopt, and
said council shall prescribe and regulate the rates of rents to
be paid for the use of the water furnished by said town; may
impose fines and penalties for the injury or abuse of said works
or property connected therewith, or for the misuse or abuse of
the water privileges furnished by said town, and may enforce
and collect such water-rents, fines and penalties, by distress or
otherwise, as said council may determine.
4. The said council shall provide by suitable ordinances for
the payment of the interest on the money borrowed, and for
which bonds shall be given as aforesaid, and for the redemp-
tion of the principal by providing a sinking fund therefor, or
otherwise, as it may deem best.
5. For the purpose of erecting, building, enlarging or im-
proving said water-works, and laying pipes therefrom, said
town may acquire by purchase or otherwise, and hold, such
real or personal property within or without said town as may
be necessary therefor; and may have such lands, within or
without the town, condemned, by proceeding before the proper
tribunal having jurisdiction over the same, in the manner pre-
scribed by the general laws of the state for condemning lands
for other works of internal improvement. |
6. This act shall be in force from its passage.
