Chap. 22.—An ACT to amend and re-enact section 6 of chapter 71 of
an act entitled an act to amend and re-enact section 1 of chapter 12
of the Code of 1878, with regard to Official Bonds, approved Feb-
ruary 2, 1876.
Approved August 26, 1884.
1. Be it enacted by the general assembly of Virginia, That
the sixth section of chapter seventy-one of an act entitled an
act to amend and re-enact section six of chapter twelve of
the Code of eighteen hundred and seventy-three, with regard
to official bonds, approved February second, eighteen hun-
dred and seventy-five, be amended and re-enacted so as to
read as follows:
§1. Every bond required by law to be taken or approved
by or given before any court, board, or officer, unless other-
wise provided for, shall be made payable to the common-
wealth of Virginia, with surety, deemed sufficient by such
court, board, or officer. Every such bond required of any
person appointed to, or undertaking any office, post, or trust,
and every bond required to be taken of such person, by an
order or decree of court, unless otherwise provided for, shall
be with condition for the faithful discharge by him of the
duties of his office or trust, and when required to be taken
or approved by or before the governor, or a court or the clerk
of a court, shall be proved or acknowledged before the gov-
ernor or court, or clerk as the case may be, and recorded by
the secretary of the commonwealth in the first place, or by
the clerk of the court in the other cases; and where the said
bond is taken under any order or decree in a pending cause,
a certified copy thereof shall be filed in the said cause by the
said clerk, and charged amongst the costs of the cause. All
bonds taken in pursuance of any of the requirements and
provisions of law aforesaid or of any order of court, shall
contain, as to all the obligors executing the same, a waiver
of the homestead exemption, and also a waiver of any claim,
right, or privilege to discharge any liability arising under
said bond, or by virtue of said office or trust, in any currency,
funds, counter-claims or offsets other than legal tender cur-
rency of the United States. .
2. This act shall be in force from its passage.
