Chap. 96.—An ACT to amend the charter of Mount Hebron cemetery.
Approved February 8, 1884.
1. Be it enacted by the general assembly of Virginia, That
section one of an act for the incorporation of the Mount
Hebron cemetery, passed February tenth, eighteen hundred
and forty-four, be amended and re-enacted so as to read as
follows:
§1. Be it enacted by the general assembly of Virginia,
That the persons named in the preamble to this act, and their
succcasors in office, be, and they are hereby made and con-
stituted a body politic and corporate, under the name and
style of the Mount Hebron cemetery company, with full
ower in that name, to sue and be sued, plead and be im-
pleaded, to have a common seal, to make by-laws, rules and
regulations for the government of the company, to hold
property, make contracts, and have such powers and capacity
as is usual in such cases: provided that the real estate held
by said company shall be held and used for no other purpose
than a cemetery; and shall not exceed in quantity fifty acres
of land; and provided further, that the money and personal
property shall not exceed one hundred thousand dollars; and
provided further, that the money derived from the sales of
lots in said cemetery, shall be applied by the trustees, tirst,
to the payment of any purchase-money that may be due from
said Company, and unpaid for the real estate purchased by it;
and secondly, after such payment, to the discharge of the
current expenses of said company, so far as the income
derived from other sources shall not be sufficient for that pur-
pose, and the residue of such proceeds of sale shall be safely
invested. by the trustees in some well-secured interest-bear-
ing tunds, the interest whereof’ shall be collected annually,
and applied by said trustees to the preservation and i improve-
ment of said cemetery.
2. This act shall be in force from its passage.
