Chap. 80.—An ACT to repeal chapter 184 of the Acts of Assembly of
1881-2 in relation to working the Konds of the county of Botetourt,
and to amend and re-enact sections 21, 23 and 28 of chapter 181 of
the Acts of Assembly of 1874-5, entitled an act to provide for Work-
ing and keeping in order the Roads of the Commonwealth, so far as
they apply to the county of Botetourt.

1. Be it enacted by the general assembly of Virginia, That
chapter one hundred and eighty-four of Acts of Assembly of
eic¢hteen hundred and eighty-one and ci¢hteen hundred and
eisrhtv-two, entitled an act to provide for wor king the roads
and repairing the bridges in the county of Botetourt, be and
the same is hereby repealed ; and that sections twenty- -one,
twenty-three and twenty- eight of chapter one hundred and
eighty-one of Acts of Assembly of eighteen hundred and sev-
enty-four and eighteen hundred and | seventy-five, entitled an
act to provide for working and keeping in order the roads of
the commonwealth, be amended and re- -enacted, so far as they
apply to Botetourt county, so as to read as follows:
§ 21. All male persons in each county shall be compelled
to work two days in each year on some public road therein,
ax near as may be to their residence, with the following
exceptions, namely: Ministers of the gospel, persons under
sixteen and above sixty years of age, persons who reside in a
town that provides for its poor and keeps its streets in order,
and any person who has lost a leg or an arm. Any other
person who is otherwise disabled, may be exemptcd on cer-
titicate of the county court of such disability. The two days
labor here required, shall not include any time such persons
may be required to work in changing or opening a road un-
der the general road laws.
§ 23. If the surveyor of any road precinct is unable, with
the means and labor at his disposal, to keep in good order
his road precinct, he may apply to the county court of his
county, who may authorize him to hire as many laborers
as will suffice to keep his precinct in good order, or to
repair great damages casually occurring, or open a new
road, when ordered by the court. The ‘county court may
also authorize the surveyor to purchase such material, tools
or implements as may be necessary to facilitate or econ-
omize the work in his precinct. The surveyor shall return
to the county court an itemized account, on oath, of the
expenses incurred under this section and for the hire of teams,
plows, and so fourth; also, the expense of placing and keep-
ing sign boards, as before mentioned, and the same shall be
allowed, or so much thereof as may. be just and proper, to be
paid out of the county fund: provided that the amount
allowed by the court under this section shall not be more in
any one year than twelve and a-half cents on the one hun-
dred dollars of taxable values in said county. It shall be
the duty of the county court to rigidly examine the claims
presented under this section, and certify such as it may ap-
prove to the board of supervisors ; and the said board. in its
annual levy, shall provide therefor.
§ 28. Every surveyor of a road shall be entitled to com-
pensation, at the discretion of the county court, to be by
certified to the board of supervisors, and paid out of the
county levy, not exceeding one dollar and a-balf per day for
the time actually engaged (less the two days required of him
by law), which time shall be stated in writing and sworn to.
Any surveyor of a road who shall fail to perform any duty
required of him in this act, shall pay a fine of not less than
five dollars nor more than thirty dollars.
2. The road precincts shall remain as now laid out and
described by metes and bounds in the several mayisterial dis-
tricts, until changed by the order of the county court. The
Overscers In charge ot said precincts, when this act goes into
effect, shall continue in the pertormance of’ their duties until
their successors are appointed.
3. Any road tax tickets created by virtue of chapter one
hundred and eighty-four of Acts of Assembly, eivhteen hun-
dred and eighty -one-eighty-two, remaining unpaid in the
hands of overseers, or of the district road boards, on the first
day of June, eighteen hundred and eighty-four, shall be turned
over on that day, or not later than the fifteenth day of June,
eighteen hundred and eighty-four, to the county treasurer,
and his receipt taken for the same; and the gaid receipts, con-
taining a list of said tax tickets. with the amounts due, and
by whom due, shall be filed with the clerk of the board of
supervisors, on or befure the first day of July, eighteen bun-
dred and eighty-four; and it shall be the duty of the county
treasurer to collect the same. The fund arising from these
tickets, shall be used by the board in paying claims arising
under chapter one hundred and eighty-four of the Acts of
eighteen hundred and eighty-one—-eighty-two: provided that
the said board may allow the treasurer out of ‘this fund, such
compensation for its collection as it may deem proper.
4. It shall be the duty of the county court to adopt such
rerulations as will protect and preserve all material, tools,
and implements bought by order of the court for making and
repairing the public roads.
5. Such provisions of the general road laws of the state. as
do not conflict with this act, shall continue in force in the
county named herein; and nothing in this act shall be so con-
-trued as to interfere with the ‘existing contracts for the
working of roads in said county.
6. This act shall be in force from its passage.
