Chap. 6.—An ACT to prescribe the manner in which the Norfolk and
Cincinnati Railroad ompany shall pay its tax on its mortgage to
secure bonds hereafter to be issued, and to enlarge the powers of said
Norfolk and Cincinnati Railroad Company.

1. Be it enacted by the general assembly of Virginia, That
said Norfolk and Cincinnati railroad company is hereby
authorized to record in any county any mortgage created by
it upon paying the legal fees for recording the same; and the
tax upon the bonds secured thereby to be used in the con-
struction of its line of road in this state, and without the pay-
ment of any tax upon the bonds secured thereby to be used
in constructing its lines in any other state. The proportion
of the mortgage applicable to this state to be determined by
agreement between the proper officers of the company and
the auditor of public accounts, and to be certified by the audi-
tor to the sdavle of the county in which the tax is to be paid.
2. The said company shall have power, by vote of a
majority of its stockholders, to consolidate and merge its
franchises and property with those of the Hastern Kentucky
railway of Kentucky, and with those of any railroad com-
pany, connection with whose lines may be made for the pur-
pose of reaching the iron-ore deposits of East Tennessee and
restern North Carolina, and to execute such contracts as
may be necessary to the effectual carrying out of the same;
and the said agreement so adopted, or certified copies thereof,
shall be filed in the office of the secretary of the common-
wealth and taken as the agreements, or the acts of consolida-
tion of said companies. And any consolidated company thus
formed by and under such name as it may adopt and set forth
in said agreement, shall be entitled to all the property, rights
and franchises, and subject to all the liabilities of the consoli-
dated companies.
3. The franchises conferred by this act, and the acts to
which this is a suppliment, are hereby granted and confirmed
unto the said company on condition that the work of actively
constructing its said road be commenced within two years
and completed within six years from the passage of this act,
otherwise this charter to be void.
4. This act shall be in force from its passage.
