Chap. 492.—An ACT to ratify the consolidation of the Junction and
Breakwater, Breakwater and Frankford and Worcester Railroad
Company. |

Whercas an act was passed March second, eighteen hun-
dred and seventy-six, by the general assembly of this state,
entitled an act to confer upon the Worcester railroad com-
pany, incorporated by the general assembly of Maryland,
certain corporate privileges and immunities to be exercised
within the limits of the state of Virginia; and whereas by
said act, the said Worcester railroad company was authorized
to extend its railroad within the limits of the state of Vir-
ginia, and the same rights and privileges were granted to
said Worcester railroad company within the territory of
Virginia, as are granted to it within the territory of Mary-
land; and whereas afterwards said Worcester railroad com-
pany, under and in pursuance of the provisions of said act, as
and in the manner therein provided, did extend its railroad
within the limits of Virginia; and whereas, afterwards,
under and in pursuance of the rights and privileges granted
to said Worcester railroad company, by the laws of Mary-
land, and especially an act passed May third, eighteen hun-
dred and eighty-two, by the general assembly of Maryland,
entitled an act to amend chapter seventy of the laws of eigh-
teen hundred and seventy-four, and to provide for the con-
solidation of the Worcester railroad company, a corporation
created by this stute, with the Junction and Breakwater
railroad company, and the Breakwater and Frankford rail-
road companies, corporations created by the state of Delaware,
and with other railroad companiesin Maryland and Virginia,
and under and in pursuance of the rights and = privileges
granted to said Junction and Breakwater and Breakwater
and Frankford railroad companies, by the laws of Delaware,
the said Worcester railroad company was duly consolidated
with the eaid Junction and Breakwater railroad company,
and the said Breakwater and Frankford railroad company,
so as to form one company, under the name of the Delaware,
Maryland and Virginia railroad company; which last-men-
tioned company thereupon became vested with all and singu-
lar, the rights, privileges, franchises, and property of the
Worcester railroad company, within the state of Maryland,
and with all the rights, privileges, franchises and property,
of the Junction and Breakwater and Breakwater and Frank-
ford railroad companies, within the state of Delaware;
therefore,
1. Be it enacted by the general assembly of Virginia, That
the said consolidation be and the same is hereby in all re-
spects ratified and confirmed; that the said Delaware, Mary-
land and Virginia Railroad company be and the same hereby
is vested witb all the rights, privileges, franchises, and pro-
perty of the said Worcester railroad company within this
state, and that the said Delaware, Maryland and Virginia
railroad company shall possess w ithin this state, all the cor-
porate rights, powers, immunities, privileges. and franchises
which it has or may have within the state of Maryland,
under the laws of Maryland, including the power to borrow
money to such extent as may be necessary or expedient, and
to secure the same by bond and mortgage of any or all of
its property and franchises, and the right “to lease its railroad
and other property and franc ‘hises, to any person or persons,
or body corporate, for such period, and upon such terms and
conditions as it may deem proper, and the right to consoli-
date its capital stuck, franchises, and property with the capi-
tal stock, franchises, and property of any railroad company,
created by the state of Virginia, having authority to effect
such consolidation, and having a line of railroad connected
with, or continuous to the route of said Delaware, Maryland
and Virginia railroad company.
2. The property of said Delaware, Maryland and Virginia
railroad company in this state, shall be subject to like taxa-
tion with other property therein.
3. This act shall be in force from its passage.
