Chap. 459.—An ACT to amend and re-enact section 4 of chapter 6, and
to repeal section 1, chapter 16, of the Code of 1878, in relation to
vacancies in the offices of governor and lieutenant-governor.
Approved March 17, 1884.
1. Beit enacted by the general assembly of Virginia, That
section four of chapter six, Code of cighteen hundred and
seventy-three, be amended and re -enacted so as to read as
follows:
$4. When a vacancy occurs in the office of governor and
licutenant-governor, the president pro tempore of the senate
shall assume and discharge the functions of the office of gov-
ernor until a governor shall be elected and qualified, which
shall terminate, for the time being, his duties as president
pro tempore of the senate, and shall, within five days after
such vacancy occurs, issue writs for an election for the unex-
pired term of those ofticers respectively ; the election to be
held within sixty davs after date of such w rits ; and also, in
ease the general assembly be not then in session, he shall
issue his proclamation to convene the general ‘assembly
within sixty days after. such election, in order that the voto
may be counted in the manner prescribed by the constitu-
tion; and when a vacancy occurs in the office of lieutenant-
governor, the said office, with all its duties, powers and com-
pensation, shall devolve upon the president pro tempore of
the senate, but he shall be entitled, while so acting, to his
vote in the senate, as a member thereof, If the senate be
not in session at the time the offices hercinbefore mentioned
devolve upon the president pro tempore thereof, then the
same shall devolve upon the person who was the president
pro tempore thereof at the time of the adjournment of the
last preceding session.
2. Section one of chapter sixteen, Code of eightcen hun-
dred and seventy-three, is hereby repealed.
3. This act shall be in force from its passage.
