Chap. 455.—An ACT to incorporate the town of Timberville, in Rock-
inghum county, Yjrginia.
Approved March 17, 1884.
1. Beit enacted by the general assembly of Virginia, That
the town of Timberville, in the county of Rockingham, shall
be and the same is hereby made a town corporate by the
name of the town of Timberville.
2. The boundaries of said town shall be as follows: Be-
ginning at P. Stricklers mill on the south side of Shenandoah
river; thence south, crossing Middle road to New Market
road, to and embracing residence of John Minnick; thence
east by New Market road, embracing residence of C. Faber
and Plain’s church, and down said road to point opposite S.
H. Myer’s barn; thence with 8. H. Myer’s lane to Baltimore
and Ohio railroad; thence southwest with railroad to a cul-
vert opposite John White’s lane; thence northwest, embrac-
ing residences of David Driver and Abraham Arehart, to and
embracing residence of Harvey Archart; thence west, em-
bracing residences of Mrs Futtz Myers, William Arehart and
George Archart, to the Stoner-mill road; thence south, em-
bracing residence of Mrs. Anna Will to starting point at P.
Strickler’s mill.
3. The officers of said town shall consist of five trustees,
who shall compose the council, four of whom shall constitute
a quorum to transact business; and a sergeant who shall
hold their oftices for two years, and until their successors are
elected and qualified. The said council shall have power to
pass all by-laws and ordinances nocessary for the proper gov-
ernment of said town, not in conflict with the laws or consti-
tution of the state or of the United States.
4, The said council shall elect from their own number a
president, who shall preside at all of the meetings of the
council, and when they are equally divided shall, in addition
to his individual vote, give the casting vote ; anil he shall be
invested with all the powers of a justice of the peace within
the limits of said town.
3). Jacob Garber, Charles KE. Fahrney, Wiliam A. Pierce,
John A. Roller and Samuel C. Smucker are hereby appointed
trustees of said town, and shall have and exercise all the
powers herein eranted to said officers, and shall remain in of-
tice until their successors shall be elected and qualitied ac-
cording to law.
6. The said council shall, when organized, and every two
years thereatter, appoint a auraeant, who shall be a conserva-
tor of the peace, and have the full power of a constable within
the limits of said town.
7. No license for the manufacture or sale of wine, ardent
spirits or malt Jiquors within the limits of said town, as pre-
scribed in the second section of this act, shall be granted to
any person unless such person first obtain from the town
council of said town a certificate of the council of said town
of its consent to the granting of such license, and the party
applying for such license shall present such certificate to the
person or court having the authority to grant such license.
8. The said council shall have no power to levy or collect
a tax for any purpose whatever.
9. This act shall not be construed as exempting cither per-
sons or property in the town of Timberville from service on
roads, or from county, or district, or road levies, or taxes un-
der existing laws, or laws that may hereafter be passed, un-
less such laws shall exempt the person by name.
19. This act shall be in force from its passage.
