Chap. 42.—JOINT RESOLUTION instructing the attorney-general
to forthwith institute in the circuit court of Richmond proceedings on
the official bond or bonds of Joseph Mayo, late treasurer of the com-
monwealth, to recover a loss to the Sinking Fund.

Resolved by the house of delegates (the senate concurring),
That the attorney- general be and he is hereby instructed
forthwith to institute in the circuit court for the city of Rich-
mond such suit or suits, or other proceedings, on the official
bond or bonds of Jose ‘ph Mayo, late treasurer of the common-
wealth. to recover the loss incurred to. the sinking fund as
determined and ascertained by the report of the joint com-
mittee of investigation into the affairs of the sinking fund
made to the gencral assembly March thirtieth, eighteen hun-
dred and seventy-four, or the report of John O. Steger,
Esquire. made to the governor and treasurer relative to the
condition and management of the capitol basement offices
(house document number two, journal of house of delegates
eighteen hundred and seventy-four and cighteen hundred and
seventy-five) as in his judgment is best.
2, Resolved, That should the attorney-general fail to in-
stitute within a reasonable time, not exceeding thirty days,
such suit or other proceedings, the auditor of public accounts
is hereby instructed to employ counsel to carry out the fore-
going resolution, the compensation of said counsel not to ex-
ceed ten per centum of the amount recovered, and to be contin-
gent upon the recovery, and in any event the auditor of pub.
lic accounts is directed to associate counsel with the attor-
ney-general in prosecution of such suit, suits or proceed.
