Chap. 411.—An ACT to empower the Dismal Swamp Canal Company
to construct and operate a railway on its own land from Gilmerton
Locks, in Virginia, to South Mills, in North Carolina.

1. Beit enacted by the gencral assembly of Virginia, That
the Dismal Swamp Canal ‘Company be and it is hereby em-
powered to construct and operate a railway on its own land
from Gilmerton Jocks, in Norfolk county, in this state, to
South Mills. in the county of Camden, in the state of North
Carolina, subject to the general laws of the state of Virginia:
provided that before the said company shall construct any
part of said work beyond the limits of this state, the consent
of the state of North Carolina thereto shall be lawfully ob-
tained : provided however, that such railroad shall be so con-
structed as not to interfere with the navigation of the canal
of suid company, and that any railroad so constructed, and
the rolling-stock and other property used in common there-
with, shall be liable to taxation in all respects as other rail-
road property in this state is Hable under the general laws of
the state: and provided farther, that the acceptance of this
charter by the said company shall be deemed and taken asa
release and renunciation of any and all rights which said
company have to conduct or operate a lottery or a lottery
business under any charter or act of assembly heretotore
passed.
2. This act shall be in force from its passave.
