Chap. 40.—An ACT to incorporate the town of Graham, in the county
of Tazewell.
In force January 28, 1884.
1. Be it enacted by the general assembly of Virginia, That
the town of Graham, in the county of Tazewell, as the same
has been or may be laid off into lots, streets, and alleys, shall
be and the same is hereby made a town corporate by the
name of Graham, and by that name shall have and exercise
all the powers, rights, privileges and immunities, and be sub-
ject to all the provisions of chapter fifty-four of the Code of
Virginia, of eighteen hundred and seventy-three, so far as
the same relates to towns of less than five thousand inhabi-
tunts, and are not in conflict with the powers herein con-
ferred.
2. That the boundaries of said town shall be as follows,
viz: Beginning at Crockett and McDonald’s corner, near
Crockett’s well; thence with McDonald’s line and in the same
direction to state line; thence with the said state line to the
top of Stony ridge; thence with the top of said ridge to
James Mcek’s line; thence with said line to public road lead-
ing up Right’s valley; thence with said line crossing said
road to McDonald’s line; thence with McDonald’s line so as
to include the school-bouse, to the public road; thence with
the public road to the beginning.
3. The officers of said town shall consist of one mayor, five
councilmen, three of whom shall constitute a quorum to
transact all business, and a sergeant, who shall hold their
offices for one year, and until their successors are elected and
qualified. The said council shall have power to pass all
by-laws and ordinances necessary for the proper government
of said town, not in conflict with the constitution and laws
ot the state of Virginia, or the constitution and laws of the
United States; and also to provide for the keeping of the
streets of said town in order, and tor all otber necessary
improvements.
4, The mayor shall preside at all mectings of the council,
when present, and when they are equally divided, shall give
the casting vote. And he shall be invested with all the
powers of a justice of the peace within the limits of said
town; and in the absence of the mayor, the council may elect
a president ot the meeting.
5. The sergeant shall be invested with all the powers of
a constable within the limits of said town. He shall collect
all town levies, and have power to distrain and sell therefor
in like manner as a county treasurer may distrain and sell
for state taxes. He shall be required to give bond in a sum
designated by the council of said town.
6. The said council shall have power to impose a license
tax, not exceeding five dollars on all persons on whom the
state has imposed a license tax: provided however, that they
may impose a further tax of not less than twenty dollars, or
more than two hundred and fifty dollars on liquor dealers,
and all handlers of liquor as a beverage, and keepers of bowl-
ing-alleys, billiards or bagatelle tables.
7. The said council shall have power to impose a tax not
exceeding seventy-five cents on the one hundred dollars tor
all purposes: be it provided however, that no tax be imposed
on the stock used in carrying on any business for which a
special license tax is assessed.
8. The said council shall have power to grant or refuse
license to sell by the drink, by the retail or by wholesale,
within said town or within one mile thereof, wine, malt
liquors or ardent spirits, or a mixture thercof, and power to
grant or refuse license to keepers ot bowling-alleys, billiards
or bagatelle tables.
9. The first election shall be held thirty days from the pas-
sage of this act, and each subsequent clection shall be held
on the first Monday in June; at which time the following
officers shall be elected, viz: one mayor, five councilmen, and
one town sergeant.
10. This act shall be in force from its passage.
