Chap. 333.—An ACT authorizing the town of Berryville, in Clarke
county, to issue bonds and to levy a tax to provide a sinking fund for
the purpose of providing water-works for said town.
Approved March 7, 1884.
1. Bo it enacted by the general assembly of Virginia, That
the council of the town of Berryville, to enable it to exercise
the authority conferred upon it by its charter, of erecting
water-works in or near said town, be and is hereby authorized
to borrow money on the credit of said town, and to issue
bonds, with semi-annual coupons attached, for the amount so
borrowed, at a rate of interest not exceeding six per centum
per annum, said bonds to be made payable not more than
thirty years after date, and to be redeemable at the option of
said council five years after date, or at any time thereafter.
2. It shall be lawful for the council of said town, for the
purpose of paying the interest on the bonds to be issued as
aforesaid, and of creating a sinking fund to pay the principal
thereof, and of keeping said water-works when erected, in
good repair and condition, and of defraying the expenses of
working the same, to levy a special water tax on all free male
persons within said town over sixteen years of age, dogs, and
on all real estate within said town which is not exempt from
state taxation, and all such other subjects in said town as
may at the time be assessed with state taxes: provided that
the taxes imposed by said council, for all purposes, including
said water tax, do not exceed one dollar on every hundred
dollars of the value assessed on real and personal property,
or seventy-five cents per head on each taxable person, or one-
half of the tax imposed by the state as a license tax.
3. It shall be lawful for the council of said town to make
contracts with the owners or occupicrs of property in said
town tosupply them with water, to be delivered upon or near
the premises, and in the house so owned and occupied by
them, at such prices as may be agreed upon by such con-
tracting parties.
4. This act shall be in force from its passage.
