Chap. 255.—An ACT to incorporate the town of Clintwood, in the
county of Dickenson.

Approved March 4, 1884.
1. Be it enacted by the general assembly of Virginia, That
the town of Clintwood, in the county of Dickenson, as the
same has heretofore been laid off into lots, streets, and alleys,
or as the same may be hereafter laid off into lots, streets, and
alleys, shall be, and is hereby made a town corporate, by the
name of Clintwood, and by that name shall have and exer-
cise all the powers, rights, privileges, and immunities, and be
subject to all the provisions of chapter fifty-four of the Code
of Virginia, eighteen hundred and seventy-three, so far as it
relates to towns of less than five thousand inhabitants, or by
any laws which may hereafter be enacted for the govern-
ment of said towns, and are not in conflict with the powers
herein conferred.
2. The boundaries of said town shall be embraced within
the limits of one-half mile each way from the court-lLouse
building in said town, extending east, west, north, and south,
making an area of one mile square.
3. That the officers of said town shall consist of a mayor,
four councilmen, a recorder, and sergeant. The mayor and
‘councilmen shall compose the council of said town. The said
officers shall hold their offices for one year, and until their
successors are duly elected and qualified.
4. The recorder shall keep an accurate record of all the
proceedings of the council, its by-laws, acts and ordinances,
which record shall be open at all times to the inspection of
any voter of the town; and the recorder shall be ex-officio
treasurer of said corporation, whose duties and compensation
as such, shall be prescribed by the council; and tbe council
may appoint such other officers as they may deem proper,
and may define their duties, powers, and compensation.
5. That for the purpose of carrying into effect the police
regulations of said town, shall be allowed the use of the
county jail of Dickenson county for the safe-keeping and
confinement of all persons who shall be sentenced to imprison-
ment under the ordinances of said town. When any judg-
ment shall be rendered against a person for any fine or penalty
under any ordinance of said town, and there shall be no visible
effects which the sergeant may distrain and sell therefor, the
person or persons so in default may be allowed to work out
such fine or penalties on the public streets, or other public
improvements, at fifty cents per day, under the direction of
the sergeant, and under such rules and regulations as may
be deemed proper by the council.
6. That the sergeant of said town sball be a conservator
of the peace, and be invested with the full powers of a con-
stable within the limits of said town; he shall collect the
town taxes, and may distrain and sell ‘therefor in ke man-
ner as treasurers may distrain and sell for state taxes; he
shall perform such other dutics and receive such compensa-
tion as the council may prescribe.
7. That the election of officers provided for by this act
shall be held at the court-house. in the town of Clintwood, on
the fourth Thursday in May, cighteen bundred and eielty-
four, and on the same day every year thereafter; and the
jude of the county court of Dickenson county shall, not less
than fifteen days before any election under this charter. ap-
point one registrar and three judges of election, who may
also act as commissioners of election. The registrar shall, in
the manner prescribed by the laws of the state providing for
the reyvistration of voters, make and revise lists of all persons
qualitied to vote for members of. the general assembly, and
who reside within the corporate limits of said town.
8. That James M. Thornberry shall be mayor, Columbus
Phipps, recorder; J. T. Ramey, sergeant, and John P. Chase,
J. E. French, James K. Dawson, and H. M. Jones, council-
men for said town of Clintwood, until the election in May,
eighteen hundred and eighty-four, provided for by this char-
ter, and until their successors are duly qualified.
9. That should any ot the officers hereby appointed, refuse
to accept such appointment, or fail to qualify within thirty
days after this act takes effect, then it shall be the duty of
the county judge of Dickenson county to fill such vacancy by
appointment.
10. That said council shall have authority, if they deem it
expedient, to appoint three frecholders, at their firat meeting
in each year, whose duty it shall be to assess all real and per-
sonal property in the limits of said corporation for purposes
of taxation.
11. The said council shall have power to levy such taxes
as they may deem necessary for the purposes of said town,
as is allowed by existing laws; and for the privilege of carry-
ing on any regular business in said town by persons who do
not reside within the corporate limits of said town: provided
that no tax upon the real and personal property in said town
shall exceed the amount of fifty cents upon the one hundred
dollars assessed value thereof, and that the poll tax Shall not
exceed fifty cents on each male person over the age of twenty-
one years, in any one year; and for the purpose of doing a
regular business, or following any trade, profession, occupa-
tion, or calling, within the said town by person or persons,
who do not reside within said town, not exceeding the sum
of ten dollars for any one year.
12. That in order the better to determine who shall be lia-
ble to taxation in the said town under this act, it is hereby
declared that all persons liable to taxation, as hereinbefore
set out and residing in or in pursuit of any business, trade
occupation, calling, or profession in said town as aforesaid,
annually on the first day of February, shall be subject to tax-
ation the current year.
13. All fines, penalties and amercements, and other moneys
received and raised by virtue of this act, and not otherwise
directed to be applied, shall be at the disposal of the council
for the use and benefit of said town.
14. This act to take effect on the first day of April, cighteen
hundred and eighty-four.
