Chap. 237.—An ACT to incorporate the Modoc Tribe No. 51, Improved
Order of Red Men, at Mechanicsville, Virginia.
Approved March 3, 1884.
Whereas there is established at Mechanicsville. in the
county of Hanover, in the state of Virginia, a benevolent
institution known as the Modoc Tribe, number fifty-one, Im-
proved Order of Red Men, which has for its objects mutual
aid and assistanee of its members in time of sickness, and
burial of deceased members, the support of their widows and
orphans; whereas it is helieved that the facilities of the said
institution for the accomplishment of its benevolent purposes,
would be greately promoted by obtaining an act of incorpo-
ration of said Modoe Tribe. number fifty-one, Improved Order
of Red Men; therefore,
1. Beitenacted by the general assembly of Virginia, That
Jacob F. Acre, Thomas B. Dunn, William N. Catlin, William
Haw, and R. R. Horne, and their successors in office, elected
according to the by-laws of said tribe, be and they are hereby
appointed a body, politic and corporate by the name of’ trus-
tees of Modoe Tribe, number tifty-one, Improved Order of
Red Men, at Mech: tniesville, anid by that name shall have a
perpetual succession in office, and a common seal; may sue
and be used, plead and be impleaded, and do all and every
act necessary to enjoy the powers herein vranted.
2. The said trustees may acquire, receive, hold possession
of such property, real and personal, as may be necessary for
the use of their order, and may rent, sell, convey, encumber,
and otherwise manage or dispose of the same, in such man-
ner as they shall be required by a vote of the members ot said
tribe, in regular meeting assembled: provided that the
amount of land held by them at any one time shall not ex-
ceed one acre.
3. The said tribe, at any meeting called for the purpose,
shall have power to fill all vacancies in the board of tr ustees,
the persons to fill such vacancies to be chosen from the mem-
bership of said tribe.
4. Whenever the said tribe shall from any cause cease to
exist, the said trustees, or a majority of them, shall have
authority to sell and convey the land and other property
held by them, for the use of their order, and distribute the
money arising from such sale, and any other money belong-
ing to the said tribe, ratably among the members in coo
stand: ing at the time the said order ceased to exist.
5. Three trustees shall constitute a quorum for the trans-
action of any business under this act.
6. This act shall be in force from its passage.
