Chap. 226.—An ACT to give the consent of this state to the purchase,
occupation, improvement and use by the United States of certain real
estate in the city of Fredericksburg, and county of Spotsylvania, in
order to open aud maintain an improved highway from said city to
the National Cemetery, near said city.
Approved March 3, 1884.
Whereas it is represented to the gencral assembly that a
bill is now pending in the congress of the United States,
authorizing the latter to open, occupy, and improve and
maintain a suitable and convenient road from the city of
Fredericksburg to the National cemetery, near said city:
1. Be it enacted by the general assembly of Virginia, That
the consent of this state be and is hereby given to the pur-
chase by the United States of such real estate in said city
and county ag may be necessary and convenient for said pur-
oses, and to the occupation, improvement and use by the
United States of any existing strects in said town, or public
roads in said county, as may ‘be needful and suit: able for said
purpose; and when the said real estate shall have been pur-
chased and the said streets or roads shall have been so occu-
pied, used and improved for said purpose. jurisdiction is
hereby ceded to the government of the United States, so that
congress and the lawtul authorities of the federal government
shall have all lawful power and control over the same: pro-
vided, however, that the consent berein given shall not extend
to the purchase or acquisition of more than ten acres of land
for said purpose; and provided further, that the state retain
concurrent jurisdiction over said real estate and said improved
road to said cemetery in all matters relating to the violation
of the laws of this state, and of the ordinances of said city,
to the execution and service of all processes issued by or
from the courts of the state and its magistrates or other state
ofticers, in pursuance of law, and in “all other matters not
incompatible with the consent herein given, and the rightful
authority of the United States thereby acquired and to be
acquired under this act.
2. The said real estate and said improved road are hereby
exempted from all taxes imposed or to be imposed by this
state and constituted authorities of said city and county, so
long as the same shall be held, maintained and used by the
federal government for the purposes hereinbefore mentioned,
and no longer.
3. This act shall be in force from its passage.
