Chap. 150.—An ACT to amend section 10, chapter 17, Code of 1873,
in relation to the suspension and removal of certain officers.
In force February 23, 1884.
1. Be it enacted by the general assembly of Virginia, That
section ten, chapter seventeen, Code of eixhteen hundred and
reventy-three, be amended and re-enacted so as to read as fol-

§ 10. Any of the said officers may be removed from office
by joint vote of both houses of the general assembly, or, dur-
inv the recess of the assembly, may be removed or suspended
by the governor, auditor of public accounts, second auditor,

of them, for misbehavior, incapacity, or neglect of official
duty; and in any case in which this power may be so exer-
cised by the governor, auditor of public accounts, second
auditor, treasurer, and secretary of the commonwealth, or a
majority of them, they shall, immediately after the com-
mencement of the next session of the general assembly, re-
port to the assembly the fact of the removal or suspension,
and the cause thereof. But no removal or suspension shall
be made under this section, except by and with the advice
and consent of the governor, and no officer charged or
accused with a view to removal or suspension, shall be a
member of the board hereby constituted as to the charges
against him.
2. This act shall be in force from its passage.
