Chap. 15.—An ACT incorporating the Air Line Turnpike and Draw
Bridge Company.
Approved January 18, 1884.
1. Be it enacted by the general assembly of Virginia, That
Joseph A. Parker, William G. W. Parker, S. B. Carney,
Henry Kirn, and William F. Wise, be and are hereby
made a body. corporate and politic, under the name and style
of the Air Line Turnpike and Draw Bridge Company, with full
und adequate powers to construct a turnpike road from some
point near the city of Portsmouth, to the east end of the
Gumpond road, and along said road to a convenient point of
departure, thence in a westerly direction to some point on the
western branch of the Elizabeth river of convenient crossing
ut or above Hodges’ ferry, thence westerly to the road lead-
ing from Bower's hill to Shoulder’s hill, and along said road
to Shoulder’s hill: provided that the bridge hereby author-
ized to be built across the western branch shall be con-
structed with a suitable draw, not less than twenty-five feet
wide in the clear, and subject to the provisions of the general
laws of the commonwealth applicable to such a corporation
and provided further, that the said turnpike road shall not be
less than twenty nor more than sixty feet wide.
2. The said company shall have the privilege, in making
said road or any part thereof, to use shell, plank, sand, or any
other material, and shall be privileged to provide open ditches
on either side of said road.
3. The said company, in constructing or extending said
road or turnpike, shall have the right, with the consent of
the court of the county in which the road lics, to use the bed
of any public road, and shall have the control of the entire
width of said road so far as they may extend the said turn-
pike along the line of the same. And the said company shall
have power to condemn and use, by compliance with the
general Jaws in such cases, the private lands of individuals,
when it is necessary to obtain the proper grade or location of
the road-bed or vates.
4, The said company is hereby authorized to extend the
road to Suffolk, and build lateral or branch roads in any
direction not excceding ten miles each, with the same privi-
leges as conferred in preceeding sections.
5. The said company shall be, and is hereby authorized to
erect a gate or gates across said road at such points as they
may deem expedient, and to charge toll as the board of direc-
tors may order: provided that the rate of said road does not
exceed the lawful rates, and on the bridge those now charged
over the western branch draw- bridge.
6. The capital stock of said company shall not be less than
ten thousand dollars, nor more than fifty thousand dollars, to
be divided into shares of fifty dollars each, and books of sub-
scription may be opened by any three of the corporators or
such other persons as they may appoint, at such time and
place as they may select, for the purpose of receiving sub-
criptions to the capital stock, and when the minimum stock
x subscribed, and two dollars per share paid thereon, the said
‘orporators may proceed to organize the company as is pro-
rided by law.
7. The said company is hereby authorized to acquire such
and by donation or otherwise, as may be necessary for the
isiness of the company, and to convey and dispose of the
ame.
8. The said company may erect a pier on the Western
ranch, and collect wharfage for anything passing over the
ame.
9. This company shall have the right to acquire an inter-
st in or consolidate with any other turnpike or draw-bridge
‘company In this state, and said companics shall bave the
came privileges with regard to this company.
1). All acts or parts of acts inconsistent with this act, are
hereby repealed. .
11. This act shall be in force from its passave.
