Chap. 128.—An ACT to amend and re-enact section 6, chapter 127 of
the Code of 18738, as to liability of heirs of devisees for debts of dece-
dents.

1. Be it enacted by the gencral assembly of Virginia, That
section six of chapter one “hundred and twenty-seven of the
Code of cightcen hundred and seventy-three, be amended and
re-enacted 60 as to read as follows:
§6. An heir or devisee may be sued in equity by any
creditor to whom a debt 18 due for which the estate des-
cended, or devisee is liable, or for which the said heir or devisee
is liable in respect to such estate; and he shall not be liable
to an action at law for any matter for which there may
be redress by such suit in equity. And all judgments or
decrees for any such debt hereatter rendered against the per-
sonal representative of the decedent, through whom such heir
or devisee claims, shall be prima facie evidence of such debt
against such heir or devisee in such suit in equity.
2. This act shall be in force from its passage.
