Chap. 255.—An ACT to amend section 4 of chapter 100 of the Code,
in relation to catching fish for the purpose of manufacturing the same
into oil or manure.

1. Be it enacted by the general assembly, That section four,
chapter one hundred, of the Code of eighteen hundred and
seventy-three, be amended and re-enacted so as to read as
follows:
§ 4. Hereafter. it shall not be lawful for any person to
engave in the business of grinding, pressing, or manufactur-
ing oil or manure from the fish known as alewives or menha-
den; nor shall any person grind up, press, or boil any fish
taken or cuught in the waters of the state, or manufacture
the same into oil or manure; nor shall any person build or
erect within the limits of the state any machinery or appa-
ratus of any kind for the purpose of manufacturing oil or
manure, who has not been a resident of the state for the
period of twelve months prior thereto; and before any such
person shall manufacture into oil or manure any fish, as
aforesaid, or grind up, press, or boil any fish taken or caught,
as aforesaid, or ercct any machinery or apparatus of any
kind for the purpose of manufacturing oil or manure from
fish, he shall first obtain from the county court of the county
in which he proposes or intends to carry on the business of
manufacturing fish into oil and manure a certificate author-
izing him to obtain a license to carry on such business. No
such certificate shall be awarded by the county court unless
such person has been a resident of the state for twelve
months next preceding the application for said certificate.
Upon such certificate being obtained as aforesaid, the com-
missioner of the revenue for the county in which said busi-
ness is to be conducted, shall issue a license to said applicant,
which shall entitle him to conduct and carry on the business
aforesaid from the date of said license until the thirty-first
day of December following; and for the license so issued, the
said applicant shall pay the sum of ten dollars, which shall
be the tax in full imposed upon all sales not exceeding the
sum of two thousand dollars; and for all sales in excess of
two thousand dollars, there shall be paid a tax of one-half of
one per centum. Every person who heads or commands a
fishing crew, or gang of men, controlling, working, or using
a seine or purse-nct to be used in catching alewives or men-
haden for the purpose of manufacturing oil or manure from
said fish, or selling said fish to any one engaged in the manu-
facture of said oil or manure, shall, before commencing said
business or occupation, first obtain from the county court of
the county in which he resides, a certificate authorizing him
to obtain a license to carry on the business or occupation as
aforesaid; and no such certificate shall be awarded by the
county court unless such person has been a resident of the
state for twelve months next preceding the application for
said certificate. Upon such certificate being obtained as
aforesaid. the commissioner of the revenue for the county
aforesaid, shall issue to said applicant a license, which said
license shall, be numbered, to carry on his business, as afore-
said, in the manner and form hereinbefore provided tor manu-
facturers; and for the license so issued, the said applicant
shall pay the sum of five dollars. Every boat used for
throwing or fishing with a seine or purse-net shall be num-
bered on the starboard bow in black figures, not less than
six inches in height and one inch in width, which said
number shall correspond with the number of the license of
the head man of the crew working said boat, which license
shall be kept on said boat. and be subject to inspection of any
conservator of the peace. All persons licensed under the
provisions of this section, are declared conservators of the
peace; and any person vivlating any of the provisions cf this
act shall be deemed guilty of a misdemeanor, and upon con-
viction thereot, shall forteit his vessel, boat. or craft. and all
purse-nets, seines, fishing tackle. and otber machinery used
in manufacturing. taking. or catchiny said fish, and in addi-
tion thereto, shall be tined not exceeding one thousand dol-
lars—one-fourth of which shall go to the informer. No tax
other than that berein described. shall be imposed by law
either upon the aforesaid oil or manure.
2. This act shall be in force from its passage.
