Chap. 230.—An ACT to protect Jand owners in making advances to
tenants.
Approved March 6, 1882.
1. Be it enacted by the general assembly, That if any
person or persons, being owners or occupiers of land, shall
contract with any person or persons to cultivate such land,
or any portion thereof, for a part of the crop raised thereon,
and shall make any advance or advances, either in money or
supplies, to such person or persons so contracting to cultivate
such land, the person or persons so making such advance or
advances shall he entitled to a lien on the crops which may
be made during the year, upon such land, to the extent of
such advance or advances, which lien shall be prior to all
other liens on such crop; and the person or persons making
such advance or advances shall bave the same remedy for
the enforcement of such lien, by distress, as is given a land-
lord for the recovery of rent under chapter one hundred and
thirty-four of the Code of Virginia, and a bond taken for the
forthcoming of property levied on under this act may be
defended in the same manner and for the same cause as a
similar bond taken under a distress warrant: provided that
any person suing out a distress warrant under tbis act, or
his agent, shall firat make affidavit to the amount and justice
of his claim, that he has present cause of action therefor,
that there will be no sacrifice to any party by an immediate
sale of the crop sought to be subjected, that the amount
claimed is for advances made to a person or persons cultivat-
ing his land, and that such advances were made by contract,
which facts, if disputed, must be proved: and provided
furtber, that such lien shall not extend to any crop not raised
during the year in which said advance or advances were
made.
2. This act shall be in force from its passage.
