Chap. 202.—An ACT to constitute the town of Abingdon, and a cer-
tain portion of the surrounding country, a separate school district.
Approved March 3, 1882.
1. Be it enacted by the general assembly of Virginia, That
the town of Abingdon, in the county of Washington, together
with the territory that has been, or may hereafter be attached
thereto, having been organized into a separate school district
by the council of said town, and board of trustees, of Abing-
don school district, shall constitute a separate school district
to be governed by the provisions of the general law on the
subject, except so far as they may be modified by the provi-
sions of this act.
2. There shall be attached to the town of Abingdon, for
public school purposes, so much of the surrounding country
as the trustees of Abingdon and Cave City school districts
shall agree upon: provided, however, that at such time and
within said district, as the council of the town of Abingdon
may designate, the question of agreeing to the arrangement
herein provided for, shall be submitted to the duly qualified
voters residing within said district, but without the corpo-
rate limits of the said town, of which notice shall be given
by publication in some newspaper published in said town,
and such other mode as said council may adopt, at least
fifteen days before the time of voting on said question; the
mode and manner of such voting to be prescribed by said
council.
3. If a majority of the votes on said question shall be
against the arrangement herein provided for, then, and in
that event the provisions of this act shall be null and void so
far as the surrounding territory is concerned—but the act
shall be binding on Abingdon. But if such majority be in
favor of the arrangement herein provided for, then and in
that event the said town of Abingdon, and the territory
embraced within said agreement of the trustees of Abingdon
and Cave City school districts, shall constitute a separate
school district, to be known as the Cave City school district.
and the following provisions shall be applicable thereto:
4. The council of said town of Abingdon shall have the
power to appoint three school trustees, from any part of such
district, to serve one, two, and three years, respectively, and
annually thereafter it shall appoint a school trustee to serve
for three years. The said trustees shall have power to man-
age and regulate the schools, to appoint teachers, fix the
salaries, provide for all necessary expenses, and perform all
other duties, and be clothed with all the power now vested in
trustees of school districts.
5. The trustees of said school district shall have authority
to use and control, for school purposes, the public school
property in said separate school district.
6. It shall be lawful for said town of Abingdon to provide
for the support of the schools therein by levying a capita-
tion tax of not less than fifty cents, and a pro rata tax on
real and personal property within said district of not less
than ten nor more than thirty cents on every hundred dol-
lars thereof, to be determined by the school trustees. The
aaid tax shall be collected by such officer, or officers, as shall
be appointed or directed by said town council to collect the
same, and be turned over by him to the treasurer of said
town, who shall keep a separate account thereof, and disburse
the same according to the order, or orders, of said board of
trustees; but said separate district shall be exempt from
county school tax.
7. The said town council shall have power, from time to
time, to levy and collect from the property holders of said
district such additional tax as may be required, in the judg-
ment of the school trustees, for school purposes in said dis-
trict: provided that the total tax so collected in any year
shall not exceed three mills on the dollar in any one year.
8. All state school funds to which said district shall be
entitled, shall be apportioned accordingly, and turned over in
bulk to the treasurer of said town of Abingdon, without com-
mission.
9. This act shall be in force from its passage.
