Chap. 260.—An ACT to amend and re-enact section three of an act
entitled an act for the protection of game.
Approved March 14, 1878.
1. Be it enacted by the general assembly of Virginia, That
section third of an act entitled an act for the protection of
game, approved March twenty-ninth, eighteen hundred and
reventy-seven, be amended and re-enacted so as to read as
follows:
§ 3. It shall not be lawful forany person to kill or capture,
oor have in his possession, any wild water-fowl in this state
between the first day of April and the first day of Septem-
ber of cach year; nor shall it be lawful to kill or capture
said water-fowl at any time during the night, that is, be-
tween dark and daybreak. Nor shall it be lawful to kill
wild water-fowl except with a gun that can be raised and
fired at arm’s length without rest. Wild geese may be killed
either during the day or night: provided that in no case
shall floating reflectors, lamps, or lights of any kind be used.
In shooting wild geese in the night time: provided further,
that nothing in this act shall apply to the wild duck com-
monly called wood or summer duck, or to the wild fowl
known as and commonly called sora: provided further, that
no sloop or other decked boat shall be allowed, at any time,
to be used in-the day or night in the aid of thase engaged in
killing wild water-fowl of any description in this state.
2. This act shall be in force from its passage.
