Chap. 148.—An ACT to amend and re-enact the third and fifth sections
of an act entitled an act to provide a method of settling the accounts
of the banks of Rockingham and Berkeley, as to outstanding circu-
lation, approved March Zl, 1877.

Whereas, the Bank of Berkeley having ceased to exist as
an organization, and the former officials of said bank repre-
sent that it has no claim avainst the state of Virginia, and
no representative who is authorized to receive any of the
benefits specified in the act approved March twenty-one,
eighteen hundred and seventy-seven; and whereas the Bank
of Rockingham having complicd with the requirements of
the said act; therefore,
1. Be it enacted by the general assembly of Virginia,
That the third and fifth sections of the act approved March
twenty-one, eighteen hundred and seven, entitled an act to
provide a method of settling the accounts of the banks of
Rockingham and Berkeley, as to the outstanding circulation,
be amended and re-enacted so as to read as follows:
§ 3. At the time named in the said notice, the said treas-
urer shall deliver to the Bank of Rockingbam all the bonds
and certificates remaining in his possession, as enumerated
in the first section of this act, and which are by said section
set apart for the use and benefit of the banks of Rocking-
bam and Berkeley.
§ 5. This act shall not take effect until the Bank of Rock-
ingbam shall, through its late casbier, file a written assent
to the same, and shall file a bond payable to the common-
wealth in the penalty of one thousand dollars, with sureties
to be approved by the treasurer, conditioned to indemnify
and save the commonwealth harmless from any claim on the
part of the Bank of Berkeley, or its successors or assignees.
2. This act shall be in force from its passage.
