Chap. 142.—An ACT authorizing the board of supervisors of Middle-
sex county to levy for and collect, and to invest certain school funds
in Middlesex county.
Approved March 4, 1878.
Whereas, by an act of the general assembly of Virginia,
passed nineteenth of March, cighteen hundred and fifty, en-
titled an act concerning the school fund of Middlesex county,
and amended the twenty-first of March, eighteen hundred
and fifty-three, by an act entitled an act to amend the act
entitled an act concerning the school fund of Middlesex
county, passed March nineteenth, eighteen hundred and fifty,
the county court of Middlesex borrowed of the school com-
missioners of Middlesex county the sum of two thousand
nine hundred dollars, which was invested in the building of
a new court-house, the interest upon which has been regu-
larly and annually paid to the said commissioners up to
date; and, whereas the board of supervisors are desirous to
pay the same and to relieve the county court of said debt;
therefore,
1. Be it resolved by the general assembly of Virginia,
That the board of supervisors for the county of Middlesex
be and are hereby authorized and empowered to levy for and
pay the said principal sum of two thousand nine hundred
dollars, or such part thereof as may not bave been levied for
and paid over, in such instalments as to them may appear
best, and to immediatcly lend out the same to some respon-
sible person or persons at the rate of six per centum interest,
taking bond therefor, made payable to said supervisors, or
their successors In office, and secured by deed of trust upon
unincumbered real estate of sufficient value to amply secure
said fund. The supervisors shall report all of their proceed-
ings under this act to the circuit court of Middlesex county,
and upon the reception and coutirmation of this report by
said court, the said supervisors shall be discharged from all
liability.
2. It shall be the duty of the treasurer of Middlesex county
to collect the annual interest upon this fund and disburse the
samo, free of charge for collecting and disbursing same, in
the same manner as other school funds coming into his bands,
The circuit judge for the county of Middlesex sball be author-
ized, under this act, to make, either in term time or vacation,
such orders as may be necessary and proper to preserve the
said fund and to carry out the purposes and intent of this
act; and should the proper school authorities of said county
at any time deem it prudent and advisable to alter or change
the investment of the fund, then, upon their petition to the
judge of the circuit court of said county, either in term time
or in vacation, for that purpose, the said judge shall make
the necessary orders: provided be shall be of the opinion
that it will not endanger the safety of said fund, or be inju-
rious to the best interest of the public schools of said county.
3. This act shall be in force from its passage.
