Chap. 125.—An ACT to furnish convict Inbor to the counties of Wythe,
Carroll, and Grayson, to work upon the Raleigh and Grayson turn-
pike and Wythe and Gray-on turnpike roads.

1. Be it enacted by the general assembly, That the governor
be and he is hereby authorized and directed to furnish the
boards of supervisors of Grayson and Wythe counties, not
less than thirty nor more than filty able-bodied male convicts
from the penitentiary, to work upon the Raleigh and Gray-
son turnpike road, between Wytheville, in Wythe county,
and Independence, In Grayson county. The said convicts
shall be fed, clothed, and guarded by the state whilst at
work for said boards, at a cost of not more than the cost of
maintaining them in the penitentiary: provided that before
the said convicts are furnished the said boards of supervisors,
they shall levy a sufficient amount, apportioned between the
said counties, according to distance in each county, to place
the said turnpike in good repair, with the aid of the said
convict labor, When the Raleigh and Grayson turnpike
shall have been put in good repair, the supervisors of Gray-
son, Carroll, and Wythe counties are hereby authorized,
under the provisions of this act, to use said convict labor
furnished to said supervisors of Grayson and Wythe counties
to repair the Grayson and Raleigh turnpike road, to work
upon and repair the Wythe and Grayson turnpike on the
best grounds for a good road between the town of Wythe-
ville, in the county of Wythe, and Old Town, in the county
of Grayson: provided that the said counties of Grayson, Car-
roll, and Wythe, or either of them, shall have levied a sum
sufficient to put said road in good repair in said counties, or
either of them, with the aid of said convict labor: provided
that nothing herein contained shall be construed to interfere
with any contract previous to this date in regard to convict
labor; and the governor sball bave power to annul said con-
tract whenever, in his judgment, it shall be expedient for
him to do so.
2. This act shall be in force from its passage.
