CHaP. 111.—An ACT to amend sections 1 and 2, chapter 146, Code of
1873, in regard to the limitation of entry on or action for land.
Approved February 22, 1878.
1. Beit enacted by the general assembly of Virginia, That
sections one and two, chapter one hundred and forty-six of
the Code of eighteen hundred and seventy-three, be amended
and re-enacted so as to read as follows:
§ 1. No person shall make an entry on, or bring an action
to recover, any land lying east of the Alleghany mountains,
but within fifteen years, or any land lying west of the Alle-
ghany mountains, but within ten years next after the time
at which the right to make such entry, or bring such action,
shall have: first accrued to himself, or to some other person
through whom he claims. But for the purposes of this act,
the county of Carroll shall be held and considered as lying
wholly west of the Alleghany mountains.
§ 2. And as to any lands actually lying in the said county
of Carroll, east of the Alleghany mountains, nothing in the
last clause of the first section of this act, shall affect any
action now pending, or prevent the making of any entry, or
the bringing of any action, within two years next after the
passage hereof; but every such action now pending, and
every such entry or action that may hereafter be made or
brought, within the last-mentioned time, shall be governed
by the law existing immediately before the passage hereof.
And all actions pending and entries made, prior to the pas-
sage of this act, elsewhere than in Carroll county, shall be
governed by the law in force the day prior to the passage of
this act.
2. This act shall be in force from its passage.
