Chap. 103.—An ACT to provide for the control and investment of the
Glebe fund in the county of Northampton.
Approved February 22, 1878.
1. Be it enacted by the general assembly, That the Glebe
fund in the county of Northampton shall hereafter vest in
the board of supervisors of said county, and they shall have
the legal control and management of said fund, subject to
the provisions of this act.
; 2. That the circuit court of said county, by its decree,
shall, as soon as practicable after the passage of this act,
transfer all of the said Glebo funds under the control of said
court to the board of supervisors of said county; and all
sums of money that shall hereafter be collected in suits now
pending in said court, shall in like manner be transferred to
the said board of supervisors.
3. That all suits now pending in said circuit court, in
which the overseers of the poor are plaintiffs, shall proceed
in the name of the said overscers, until they are finally de-
termined, when the moncys realized therefrom shall be trans-
ferred to the said board of supervisors as aforesaid. And all
bonds, single bills, deeds, notes, accounts, and evidences of
debt, under the control of the said circuit court, or the over-
scers of the poor, at the passage of this act, not in litigation,
and not filed in the record of any suit, shall bo delivered up
by the said circuit court and overscers of the poor to the
said board of supervisors; and the said board shall cause
their clerk to file the same among the papers and records of
said board in the clerk’s office of the county court of said
county; and the said board of supervisors shall have the
power to sue for and recover in the name of the obligees in
said single bills and notes, all sums of money due on the
same.
4. And the said board of supervisors may, in their discre-
tion, appropriate a sum not exceeding one thousand dollars,
out of any moneys of the said Glebe fund, to the building of
an addition to the clerk’s office of said county; and the
residue of said fund the said board of supervisors shall loan
out, or invest in such securities as they may deem wise and
proper, consistent with the safety of the fund, and the inter-
est accruing therefrom, the said supervisors shall appropriate
to the poorhouse expenses of said county, and if there should
then be a balance of interest, the same shall be applied to
the payment of the county levy.
5. And: the said board of supervisors shall be authorized to
‘ deposit such sums of money as they shall receive by virtue of
this act, in some responsible bank in this state, to the credit of
the board of supervisors of Northampton county, taking a cer-
tificate of deposit therefor,.to be entered upon their records,
and filed in their papers; and no money Shall be withdrawa
or appropriated from said fund, whether on deposit or not,
except by warrant or draft, signed by the president of the
board and countersigned by the clerk, in pursuance of a
resolution of said board entered upon its records; and all
sums of money, principal and interest, which shall come to
the hands of the said supervisors in pursuance of this act, and
all appropriations, investments, and loans male by them,
they shall cause to be entered by their clerk upon their
records; and all loans, investments, and contracts made by
them in pursuance of the provisions of this act, shall be in
the name of the board of supervisors of Northampton county,
and they shall have full power and authority in their corpo-
rate name, to enforce said contracts by suit or otherwise.
6. And the said board shall, at their annual meeting in
November next ensuing, and at each and every annual meet-
ing thereafter, cause to be entered on their record book by
their clerk, a statement showing the principal of said fund,
and in what said fund is invested, all sums which may have
been received for interest during the last current year, and
what disposition has been made of the said interest, and also
what interest or income has fallen due, but which has not
been received by them, together with all costs which may
have attended the management of said fund.
7. And tho treasurer of said county, when required by the
board of supervisors, shall collect the interest when due,
upon all loans and investments made in said county, and
account for the same in his annual settlement with said board
for the county levy, receiving a commission therefor not ex-
ceeding five per centum; and for any failure faithfully to
discharge his duty under this act, he and his sureties shall be
liable upon his official bond to the amount of the damage
sustained.
8. And the supervisors of said county and their sureties,
in their official bond, for any wilful neglect of duty under
this act, shall be liable to the extent of the injury sustained ;
and all supervisors of said county bereafter elected or ap-
pointed, before entering upon the discharge of the duties of
their office, shall enter into bond, with approved security,
before the county court, or the judge thereof in vacation, in
a penalty not less than three thousand, nor more than ten
thousand dollars, to be determined by said court or judge,
conditioned for the faith‘ul discharge of the duties of their
office under the general law, and those impozed by this act.
9. This act shall be in force from its passage, and all acts
and parts of acts heretofore passed inconsistent with this act,
as to the county of Northampton, are hereby repealed.
