Chap. 59.—An ACT for the sale of Cypress church, in Surry county.
Approved February 6, 1877.
Whereas it is represented to the general assembly, by the
petition of many citizens of Surry county, that there is in
that county an old colonial church building, known as Cypress
church, with one acre of land attached, which belongs to the
people under the laws of this state, and which is faust going
todecay; and whereas said petitioners ask that the same may
be sold under authority of an act of the general assembly, in
order that it may be purchased and repaired by some reli-
gious congregation or society, and used as a place of public
worship; therefore,
1. Be it enacted by the general assembly of Virginia, That
it shall be lawful for the superintendent of the poor of said
county of Surry, and he is hereby required to sell, on the
premises, to the highest bidder, on twelve months’ credit,
with interest from the day of sale, after duly advertising the
time. place, and terms of sale, the said old church building,
known as Cypress church, and land attached, in said county
of Surry: provided that it shall only be purchased and used
by some religious congregation or society, or by trustees for
the use of such congregation or society for the purposes of
teligious worship, and that it shall not be purchased by any
individual, firm, or company for secular purposes.
2. When the purchase money shall become due, or sooner,
if the purchaser shall desire to pay before that time, said
superintendent of the poor, or his successor, as the case may
be, sball collect and receive the same, and shall appropriate
itfor the benefit of the poor of said county of Surry. He
shall report to the board of supervisors of said county, his
proceedings under this act, and accvunt with said board for
all the money that he may collect or receive under the pro-
visions hereof. Said board may allow him a reasonable com-
ponsation for his additional services under this act, as well
as all the necessary expenses incurred by him in pursuance
thereof.
3. The overseer of the poor need not require bond or se-
curity of the purchaser of said property, other than to retain
the title until all the purchase money shall be paid; when
tbat is done he shallJ execute and deliver to them, or to such
trustees, for their use, as shall be properly designated to re-
ceive the same, a good and sufficient deed or conveyance to
said property, with special warranty; but he shall make no
deed of conveyance to said property otherwise, or to other
persons than such as are allowed to purchase it under the
provisions of the first section of this act.
4, If said purchase money be not paid in full, within one
year after the same shall become due, with interest, it shall
e lawful for the overseer of the poor, and it shall be his duty,
to institute a suit in chancery in the proper court of said
county, and said court may decree a resale of said property,
but only on the terms and conditions hereinbefore provided.
The purchasers or trustees shall be made defendants in said
suit, and the proceedings therein shall be the same as in simi-
lar suits between individuals, as far as euch proceedingr may
be applicable in this case.
5. This act shall be in force from its passage.
