Chap. 296.—An ACT to confirm the charter of the New Market river
bridge company.
Approved April 3, 1877.
Whereas W. M. Sibert, D. F. Kazey, A. S. Miller, Thomas
Moore, J. B. Strayer, B. Z. Price, C. C. Henkel, and L. M. Hen-
kel, were, on the thirtieth day of August, eighteen hundred
and sixty-nine, incorporated as a joint stock company, under
the name and style of New Market River Bridge Company,
empowered to construct a turnpike from New Market, in
Shenandoah county, to New Market station, on the Orange,
Alexandria and Manassas railroad, and to erect a bridge on
the same over the North Shenandoah river; and whereas it
was provided that the capital stock of said company shall
be five thousand dollars, in shares of twenty-five dollars; that
the principal office should be in New Market; that said com-
pany should have the right to own and hold so much real
estate as their road, bridge, and necessary toll-honse might
occupy; that said road should have a general width of thirty
feet; and whereas said company was also authorized to charge
reasonable tolls on said road and bridge, and were invested
with all the rights and remedies for enforcing the collection
of the same belonging to turnpikes generally; and whereas
it was further provided that said company might sue and be
sued in their corporate name, and have all and every proper,
legal, and necessary right and privilege which corporations
of the same kind usually have; and whereas said five thou-
sand dollars of capital stock was subscribed, and was paid,
in completing the road, building and rebuilding the bridge,
in money, material, and work; and the county of Sbenan-
doah surrendered to said company such portions of county
roads as formed a portion of said turnpike; and whereas
questions have arisen as to the legality of the action of said
courts, and of the payment of the capital stock of five thou-
sand dollars under the statute, in part in work and material
and not in money; therefore,
1. Be it enacted by the general assembly, That the action
of said circuit and county courts of Shenandoah county is
hereby confirmed and that said charter of incorporation is
hereby ratified and made the action of the general assembly.
2. That S. P. C. Henkel, Thomas Moore, Christian Shirley,
D. F. Kazey, W. H. Rice, S. P. Shirley, and L. P. Henkel,
be, and they are hereby declared to be the successors of the
original corporators, with power in the stockholders to per-
petuate the New Market river bridge company in tbeir suc-
cessors; that all the acts of the original corporators and their
successors, done in accordance with the original charter, are
hereby ratified and confirmed. Said New Market river bridge
company shall bave power to make and enforce all necessary
laws for its operation not inconsistent with the constitution
and laws of the state of Virginia.
3. This act sball be in force from its passage.
