Chap. 207.—An ACT to amend and re-enact section twenty-one of an
act approved July 9, 1870, entitled an act amending the charter of
the town of Harrisonburg, in the county of Rockingham, and en-
larging and extending the corporate limits of said town, and section
twenty-two of said act as amended by an act in force February 10,
1875.

1. Be it enacted by the general assembly, That section
twenty-one of an act approved July ninth, eighteen hundred
and seventy, entitled an act amending the charter of the town
of Harrisonburg, in the county of Rockingham, and enlarging
and extending the corporate limits of said town, and section
twenty-two of said act, as amended by an act in force Feb-
ruary tenth, eighteen hundred and seventy-three, entitled an
act to amend and re-enact sections seventeen and twenty-two
of an act amending the charter of the town of Harrisonburg,
passed July ninth, eighteen hundred and seventy, be amended
and re-enacted so as to read as follows:
§ 21. The treasurer shall collect the taxes and levies in the
same manner as is now provided by law, or as may hereatter
be provided, in relation to county treasurers, except that the
common council of the town shall fix the compensation of
the treasurer; and the said treasurer shall be vested with all
the powers for the collection of such tuxes that are now or
may @reafter be vested in the county treasurers. The trea-
surer may appoint one or more deputies to assist him in the
performance of the duties of his office, whose appointment
shall be approved by the common council, and who shall be
subject to removal by the treasurer or by the council. The
treasurer shall have charge of all moneys belonging to said
town, and shall pay the same out on the order of the mayor,
countersigned by the recorder, and not otherwise; and he
shall be subject to all the liabilities and penalties that are
now or may hereatter be imposed upon county treasurers.
At the time of his qualification, the treasurer shall give bond,
with sureties, and in penalty, to be approved and fixed by
the council; and for any default or liability on the part of
the treasurer, the council, in the corporate name uf said town,
may, on motion, after ten days notice, obtain judgment before
the county or circuit court of Rockingham county against
him and his sureties, or any or cither of them, or their heirs
or lezal representatives.
§ 22. The sergeant shall collect all fines and penalties im-
posed by the common council, the mayor, or other officer of
the town, and shall, within the town, and for two miles out-
side of the corporate limits thereof, exercise all the powers
and perform all the duties that a constable can legally exer-
cise and is required to perform, in regard to making arrests,
the collection of claims, and executing and levying process.
Ife shall-be entitled to the same compensation therefor, and
shall, together with his surcties, be liable to all the fines and
forfeitures to which a constable is now or shall hereafter be
liable, to be recovered in the same manner and before the
same tribunals as such fines and forfeitures are now or shall
hereafter be made recoverable against constables.
2. This act shall be in furce from its passage.
