Chap. 110.—An ACT in relation to the Winchester and Strasburg Rail-
road Company, and for its relief.
Approved February 26, 1877.
Whereas, by an act of the legislature of Virginia, passed
April twenty-third, eighteen hundred and sixty-seven, the
Winchester and Strasburg railroad company was incorporated
for the purpose of constructing a railroad from the town of
Winchester, in the county of Frederick, to the town of Stras-
burg, in the county of Shenandoah, with authority to connect
the same with the Winchester and Potomac, and Manassas
Gap railroads: and whereas the said Winchester and Stras-
targ railroad company have constructed aud completed, un-
der the provisions of said act, a railroad from the said town
of Winchester to a point on the Manassas Gap railroad, near
the said town of Strasburg, and by means of the use of the
irack of the said Manassas Gap railroad, are willing to run,
or procure to be run, by {ts lessee or other person, or corpo-
ration operating its said road, trains to said town of Strasburg,
atand from a convenient and suitable depot, to be erected or
constructed on the line of the said Manassas Gap railroad, in
the limits of the said town of Strasburg, at or near the Caton
crossing, and is willing to treat and regard the said depot,
when so crected and constructed, as a regular station on its
road, for such trains as are accustomed to stop at stations of
4similar character and dignity on its own road, and by the
acceptance of the provisions of this act, signifies its assent to
the amendment of its charter as herein made or provided;
therefore,
1. Be it enacted by the general assembly of Virginia, That
the said the Winchester and Strasburg railroad company, are
hereby released and relieved from any and all obligations or
liability imposed by its charter to further construct its said
road, and is hereby released and relieved from aH penalties
and forfeitures for any failure to construct its said road, to
tbe said town of Strasburg, or to further comply with the
terms of its charter in reference thereto: provided the said
company shall erect or construct, keep and use, for the con-
venience of the people of Strasburg and vicinity, the said
depot aforesaid: and provided further, that upon the failure
of said company to so keep said depot, the provisions of this
act shall be deemed and held to be null and void: and pro-
vided further, that said company shall use due diligence in
the erection or construction of the said depot, and in any
event, shall have the same completed within one year from
the passage of this act, unless said company shall be re-
strained or prevented by legal process from so erecting and
completing the said depot, in which event the said company
shall have, in addition to said one year, the further time,
during which they are so prevented or restrained as afore-
said, for the erection and completion of the said depot. And
the provisions of this act are subject to the further excep-
tion, that said town of Strasburg, shall by its proper author-
ities secure and guaranty to the said company the perpetual
use of the streets and alleys of said town of Strasburg, adja-
cent to the said Caton crossing, as approaches to said depot,
and for the use of said company in erecting the same. The
true intent and meaning of this act being to treat and regard
the keeping of said depot as a full compliance with the terms
of the charter of said company with reference to said town
of Strasburg.
2. That the said the Winchester and Strasburg railroad
company be, and is hereby, authorized, at and near said Ca-
ton crossing, to acquire, in the mode prescribed by law, and
hold real estate for the purposes of said depot aforesaid.
3. This act shall be in force from and after ita passage.
