Chap. 62.—An ACT to Incorporate the Town of Gladeville, in the
County of Wise.
Approved February 24, 1874.
1. Be it enacted by the general assembly, That the town
of Gladeville, in the county of Wise, as the same has been
or may be laid off into lots, streets and alleys, shall be and
the same is hereby made a tewn corporate by the name of
Gladeville, and by that name shall have and exercise all the
powers, rights, privileges and immunities, and be subject to
all the provisions of chapter fifty-four of the Code of Vir-
ginia, eighteen hundred and seventy-three, so far as the same
relate to towns of less than five thousand inhabitants, and
are not in conflict with the powers herein conferred.
2. That the boundaries of said town shall be as follows,
viz: Beginning at Chalybeate Springs, ards northeast
of the courthouse in said town, thence south sixty-four de-
grees east, seventy-five poles to a stake; from thence south
sixty-four degrees west, one hundred and ten poles to a stake;
thence north sixty-four degrees west, one hundred and fifty
poles to a stake; frem thence north sixty-four degrees east,
one hundred and ten poles to a stake; from thence south
sixty-four degrees east, seventy-five poles to the beginning.
3. That the officers of said town shall cohsist of a mayor,
four trustees, a recorder, and sergeant. The mayor and
trustees shall compose the council of said town. The said
officers shall hold their offices for one year and until their
successors are duly elected and qualified.
4. The recorder shall keep an accurate record of all of the
proceedings of the council, its by-laws, acts, and ordinances,
which record shall be open at all times to the inspection of
aauy voter of the town, and the recorder shall be ex-officio
treasurer of said corporation, whose duties and compensation
as such shall be prescribed by the council, and the council
may appoint such other officers as they may deem proper,
and define their powers, duties, and compensation.
| §. That for the purpose of carrying iuto effect the police
regulations of said town, the said town shall be allowed the
use of the county jail of Wise county for the safe keeping
. and confinement of all persons who shall be sentenced to
imprisonment under the ordinances of said town. When any
- judgment shall be rendered against a person for any fine or
penalty under any ordinance of said town, and there shall
e no visible effects which the sergeant may distrain and sell
therefor, the person or persons so in default may be allowed
to work out such fines or penalties on the public streets or
other public improvements, at fifty cents per day, under the
direction of the sergeant and under such rules and regula-
2 tions a8 may be deemed proper by the council.
6. That the sergeant of said town shall be a conservator
of the peace and invested with the full powers of a constable
within the limits of said town; he shall collect the town
taxes and may distrain and sell therefor in like manner as a
’ township collector may distrain and sell for state taxes; he
shall perform such other duties and receive such compensa-
- tion as the council may prescribe.
7. That the election for the officers provided for by this
act shall be held at the court-house of Wise county on the
second Saturday in December, eighteen hundred and seventy-
four, and on the same day every year thereafter. And the
council shall, not less than fifteen days before any election
under this charter, appoint one registrar and three judges of
election, who may also act as commissioners of election. The
regietrar shall, in the manner prescribed by the lawa of this
state providing for registration of voters, make and revise
lista of all persons qualified to vote for members of the gen-
eral assembly and who reside within the corporate limits of
said town.
8. That David F. Stallard shall be mayor, Tazewell G.
Wells, recorder, James M. Gibson, sergeant, and David E.
Wells, H. H. Dotson, H. C. Williamson, and C. F. Flanary
trusteocs for said town of Gladeville until the election in De-
cember, eighteen hundred and seventy-four, provided for by
this charter, and until their successors are duly qualified.
9. That should any of the officers hereby appointed refuse Vac
to accept such appointment or fail to qualify within thirty oo
days, then it shall be the duty of the county judge of Wise
county to fill such vacancy by appointment. Com
