Chap. 219.—An ACT for the relief of the sureties of William Sample,
late Sheriff of Russell County.
Approved April 20, 1874.
1. Be it enacted by the general assembly, That it shall be
lawful for any one or more of the sureties of William Sam-
ple, late sheriff of Russell county, to use the name of the
commonwealth, for their benefit, in prosecuting or defending
any suit, at his or their own expense, in the circuit court of
Russell county, with a view to subjecting the property of the
said William Sample to the payment of a judgment recov-
ered by the commonwealth against him and his sureties;
and that the said sureties shall have all the rights, privileges
and immunities which the commonwealth would have in
prosecuting or defending a suit for the same object.
2. Be it further enacted, That whenever the said sureties
shall pay the balance due upon said judgment, the auditor of
public accounts shall assign to said sureties (or to such of
them as have paid such balance) the said judgment, without
recourse; and that such assignment shall carry with it, and
invest such surety or sureties with all the rights, privileges
and immunities which the commonwealth possesses, to en-
force the collection of the same from the said Sample and his
sureties; and that the circuit court of Russell county shall
have jurisdiction of any suit which may be brought by such
surety or sureties to subject the property of said Sample to
the payment of said judgment.
3. Be it further enacted, That if the said sureties shall not,
on or before the first day of March, eighteen hundred and sev-
enty-five, pay the balance due upon said judgment, that then
the auditor shall direct the immediate collection of said judg-
ment.
4. Nothing in this act shall be construed to release or im-
pair the validity of said judgment as a lien upon the pro-
perty of said Sample and his sureties.
5. This act shall be in force from its passage.
