Chap. 191.—An ACT to amend and re-enact an Act Entitled an Act to
Incorporate The Richmond and Fair Oaks Turnpike Company, in the
County of Henrico, Approved March 27th, 1878.

_ 1. Be it enacted by the general assembly, That the act en-
titled an act to incorporate The Richmond and Fair Oaks
parnpike Company, in the county of Henrico, approved
«March twenty-seventh, eighteen. hundred and seventy-three,
be amended and re-enacted so as to read as follows:
“§ 1. Be it enacted by the general assembly, That for the
purpose of constructing a turnpike road from the limits of
the city of Richmond, near Twenty-fifth and Venable streets,
passing near the place known as Fair Oaks, to a suitable
point on the Cold Harbor road, in the county of Hanover, it.
Shall be lawfal to open books for receiving subscriptions to
ab amount not exceeding six thousand dollars, divided into
shares of twenty dollars each, to constitute a joint capital
stock. The said books shall be opened under the direction
of Shelton C. Davis, Elijah Baker, Doctor Peterfield Trent,
'L. 8. Courtney, R. M. Thorn, Robert C. Braxton, C. L. Mil-
ler, A. G. Babcock, John Blake, J. J. Hawks, George M. Fleck,
Alfred Moses, E. D. Eacho, B. H. Conner, Jefferson Powers,
E. Wood Taylor, James Lyne, John A. Eacho, J. A. Lacey,
Joseph Adams, George Watt, William Martin, Elleson Gauld-
ing, William Gaulding, Jesse Barker, John Barker, William
Jenkins, Albert Wieker, Madison Tyler, William E. Tyler
and William Bailey, or any two of them, and at such place
or places, and under the superintendence of such agents as
any three of the above named persons may appoint.
“§ 2. When thirty shares of the capital stock shall have been
subscribed, the subscribers, their executors, administrators
and assigns, shall be and they are hereby incorporated into
a company, by the name and style of The Richmond, Fair
Oaks and Cold Harbor Turnpike Company, subject to the
provisions of the Code of Virginia (edition of eighteen hun-
dred and seventy-three), and all acts amendatory thereof
applicable to and not inconsistent with the provisions of this
act: provided, that the said company shall not be required
to make a summer or side road, nor to cover the said road
with stone or gravel; that the road shall be cleared not less
than twenty feet wide, and constructed not less than sixteen
feet wide, and its grade shall nowhere exceed five’ degrees.
And the said company shall, in addition to the privileges
herein conferred, be and they are hereby authorized to erect
gates and charge tolls according to law, so soon as a section
of five miles shall be completed. The subscriptions to the
stock of the said company by persons residing or owning
lands in the county of Hanover, shall be ‘applied to the con-
struction of that part of the road lying between the point of
its intersection with the Cold Harbor road and that near the
place called Fair Oaks.
“§ 3. Parts of the public road known as the Nine-Mile road,
or the bed of any other public roads which lie along the pre-
scribed route of said turnpike in the county of Henrico, may
be taken and used by said company to construct their road
thereon: provided, that the county court of Henrico shall
consent thereto, and so direct by an order of court.
“§ 4. The said turnpike shall be commenced within one
year, and completed within two years, from the passage of this
act. .
“§ 5. This act shall be in force from its passage.”
