An Act to appropriate the public revenue for the two years ending, re-
spectively, on the thirtieth day of June, 1969, and the thirtieth day
of June, 1970.

Be it enacted by the General Assembly of Virginia:
§ 1. That the following are hereby appropriated, for the current
biennium, as set forth in the succeeding sections and items for the purposes
stated and for the years indicated:
a. The balances of appropriations made by previous acts of
the General Assembly which are unexpended at the close of busi-
ness on the last day of the previous biennium, except as continued
by Section 50 of this act; and,
b. The public taxes and arrears of taxes, as well as the rev-
enue and money derived from all other sources, which shall come
into the State treasury prior to the close of business on the last
day of the current biennium.
Such balances, public taxes, arrears of taxes, revenues, and money derived
from all other sources as are not segregated by law to special funds shall
establish and constitute the general fund of the State treasury. Except
where otherwise provided in this act, the sums appropriated are appro-
priated from the general fund of the State treasury. All special funds
shall be segregated as provided in this act, and special funds which are
not otherwise segregated by this act shall be segregated in accordance
with the acts respectively establishing such funds.
§ 2. When used in this act the term “current biennium” means the
period from the first day of July, nineteen hundred sixty-eight, through
the thirtieth day of June, nineteen hundred seventy, inclusive, and the
term “previous biennium” means the period from the first day of July
nineteen hundred sixty-six, through the thirtieth day of June, nineteen
hundred sixty-eight, inclusive.

§ 51-111.86(b), Code of Virginia, and by any agree-
ment pursuant to the cited act, to make payments to
the Contribution Fund, fails to make such payments
as are duly prescribed, either from its local employees
or on behalf of its employer’s contribution, the Board
of Trustees of the Virginia Supplemental Retirement
System shall inform the Comptroller of the delinquent
amount and political subdivision. The Comptroller
shall forthwith transfer such amount to the Contri-
bution Fund from any non-earmarked monies other-
wise distributable to such subdivision by any depart-
ment or agency of the State; provided that if the
Comptroller reports to the Board of Trustees that, by
law, no such amounts are distributable to a specified
political subdivision, the Board shall require such
subdivision to post bond or securities in an amount
sufficient to protect the State against loss from failure
by such subdivision to pay any amounts required
under the act providing Social Security coverage.
Item 69
On the first day of July in each year of the current
biennium, the Comptroller shall transfer, from each
special fund in the State treasury out of which any
State employees are paid, to (a) the retirement allow-
ance account provided in Chapter 3.2, Title 51, Code of
Virginia, and to (b) the Contribution Fund as pro-
vided in Chapter 3.1, Title 51, Code of Virginia, and to
(c) the group insurance account established pursuant
to Chapter 3.2, Title 51, of the Code of Virginia, such
amount as shall be estimated to have accrued and to
accrue on account of salaries and wages for the quar-
ter preceding and the three quarters following.
At the close of each fiscal year the Comptroller shall
adjust such transfers, if necessary, for each special
fund in accord with actual accruals for retirement,
Social Security and group insurance purposes, during
the four quarters concerned. The estimate of accruals
and the subsequent report of actual accruals shall be
supplied by the Board of Trustees of the Virginia
Supplemental Retirement System to the Comptroller
and shall be used by him in making the transfers
required by this item.
Item 70
In the event specific appropriations to State agen-
cies made in this act from special funds are insufii-
cient to provide for the transfers required under Item
69 above, the Governor is hereby authorized to in-
crease such appropriations by the additional amount
needed for such transfer; such appropriations may be
increased by transfers from the balance in special
funds or by transfers from the special funds out of
which the agency appropriations are paid.

States to the credit of such account as may be desig-
nated in accordance with the agreement entered into
under Chapter 38.1, Title 51, Code of Virginia, for the

a. Out of this appropriation shall be paid to each
widow of a Confederate soldier, sailor or marine now
on the pension roster, or hereafter placed on the
pension roster under the provisions of § 51-1 of the
Code of Virginia, the sum of $600.00 each year; pro-
vided that to each such widow who is an inmate of
an institution receiving support from the State and
each such widow who was married on or after Octo-
ber 1, 1880, and prior to January 1, 1921, and is
over 75 years of age, and who has not remarried,
shall be paid the sum of $360.00 each year. For
funeral expenses of each such deceased widow the
sum of $100.00 shall be paid to the personal repre-
sentative of such deceased widow or, without qualifi-
cation of a personal representative, to the under-
taker, upon submission to the Comptroller certifica-
tion of service rendered and certificate of death.
b. Out of this appropriation there shall be paid to
each needy maiden or widowed daughter of a Con-
federate soldier, sailor or marine, who is a resident
of Virginia, the sum of $240.00 each year. The bene-
ficiaries under this provision shall be ascertained and
determined by the relief committee of the Virginia
Division of the United Daughters of the Confederacy,
who shall certify to the Comptroller, on blanks to be
furnished by him, the need of each such beneficiaries,
said certificate to be approved by the President of the
Virginia Division of the United Daughters of the
Confederacy.
c. For purposes of payments pursuant to para-
graphs a and b, only, of this item, the appropriation
set forth in this item shall be deemed a sum sufficient.
The Comptroller shall pay at such dates as he may
prescribe the pensions authorized by this act.
d. Any unexpended portion of this appropriation
shall revert to the general funds of the State treas-

ury, and no part thereof shall be pro rated among
pensioners.
e. Out of this appropriation, there shall be ex-
pended for care of needy Confederate women who are
inmates of the Home for Needy Confederate Women
at Richmond, in accordance with the provisions of the
act approved March 4, 1914 (Acts of Assembly of

No part of this appropriation shall be available for
expenditure until satisfactory evidence of compliance
with the following conditions has been presented the

be filed with the Auditor of Public Accounts. (2)
Proof that admissions to the Home are being made
as far as practicable on the basis of first come first
served, provided that where the governing board
of the Home deviates from the policy of first come
first served the reasons therefor shall be filed with
the Auditor of Public Accounts, it being understood
that such board shall have the right to deviate from
such policy in cases which are considered by the
board to be of dire necessity or distress. (8) Upon
the admission of any guest to the Home the Auditor
of Public Accounts shall be informed thereof and
also as to the length of time which the application
has been pending; and whether it has been given
priority over other applications. (4) Copies of the
rules of admission have been filed with the Auditor
of Public Accounts. (5) No part of this appropria-
tion shall be available directly or indirectly for the
care or maintenance of any person who is not a
member of the class for which the Home was orig-
inally established.
The governing body of the Home may refuse to
admit anyone sick of an incurable disease or who is
bedridden or who is an addict to narcotics or to the
use of intoxicating liquors or who is mentally affected
to the extent of materially affecting the comfort of
the other inmates.

Out of this appropriation shall be paid the State’s
share of the following, as provided by the applicable
section of the Code of Virginia, or as otherwise pro-
vided below:
a. Salaries of county court judges, substitute
judges, and employees (§ 14.1-43); also in quarterly
installments, to each member of the committee of
Circuit Court Judges (§§ 14.1-40 and 14.1-43) the
sum of $2,000 for each year of the current bien-
nium and in addition thereto to the actual expenses
of the members of such committee (§ 14.1-40).
b. Books, stationery and supplies for county courts
(§ 16.1-49 and § 1.1-53).
c. Expenses necessarily incurred on official busi-
ness by judges of circuit, city, and corporation and
hustings courts, for postage, stationery and clerk
hire, not exceeding $300 a year for each judge.
d. Salaries of attorneys for the Commonwealth
(§ 14.1-64).
e. Other costs incident to the arrest and prosecu-
tion of persons charged with the violation of State
laws, including expenses of juries, witnesses, etc.,
except that only one fee shall be allowed any wit-
ness who attends two or more cases on the same
day. (§§ 19.1-161, 19.1-218, 19.1-219, 19.1-275,
19.1-3138).
f. Expenses incident to the representation by a
court-appointed attorney of an indigent prisoner
who is proceeded against in conformity with the
provisions of § 53-296 of the Code of Virginia, in-
cluding the payment of counsel fees as fixed by the
court; the expenses shall be paid upon receipt of
an appropriate order from the Circuit Court of the
City of Richmond.
g. The expenses incident to the prosecution of a
petition for a writ of habeas corpus by an indigent
petitioner, including the payment of counsel fees as
fixed by the court; the expenses shall be paid upon
receipt of an appropriate order from a court.
h. Salaries and expenses of sheriffs and ser-
geants and their deputies (§ 14.1-81); provided no
deduction or cut shall be made in reimbursing any
city sergeant or sheriff the actual cost of supplies
purchased by him under authority of law.
i. Cost of maintenance in local jails of persons
charged with violation of State laws, including food,
clothing, medicine, medical attention, guarding, etc.;
provided, however, that all jail physicians be paid
at the rate provided by law, but not more than five
hundred dollars per calendar year shall be paid the
jail physician or physicians for any city or county,
the population of which is less than 100,000, and
not more than one thousand dollars per calendar
year shall be paid the jail physician or physicians
of any city or county, the population of which is
100,000 or over, and coroner’s fees, etc., and said
compensation for jail physician to be paid at the
end of the calendar year, provided, however, that
in case of death or resignation, his compensation
shall be prorated on the basis of time of service
bears to the full calendar year.
j. Transportation costs of the State Prison Farm
for Defective Misdemeanants (§ 53-96).
k. Payments as ordered by the courts for the
dependents of prisoners sentenced to the Bureau
of Correctional Field Units (§ 20-63).
1. Reimbursement of public assistance payments
to dependents of persons convicted of desertion or
non-support (§ 20-63).
m. Reimbursement for salaries of judges, clerks
and other employees of juvenile courts (§ 16.1-150),
provided that no part of this appropriation shall be
paid to any county or city which expends in any
year following the fiscal year ended June 30, 1958,
less than it spent in said fiscal year for the pur-
poses for which reimbursement is provided and
authorized, and provided that the amounts expended
under this paragraph shall not exceed $540,000
in the first year and $600,000 in the second year
of the current biennium.
n. Reimbursement for one-half the travel ex-
penses of judges and of probation officers or other
officers of juvenile and domestic relations courts
when traveling under the order of the judge
($ 16.1-2138).
o. Reimbursement of expenditures for secretarial
and stenographic assistance to county probation
officers (§ 16.1-206.1).
p. The transportation costs of children committed
to the State Board of Welfare and Institutions,
and the compensation and necessary traveling ex-
penses of each agent of the State Board of Welfare
and Institutions for each day such agent is engaged
in transporting children committed to the Board to
homes, institutions, training schools or other loca-
tions. Compensation paid the agents shall be the
daily equivalent of the prevailing minimum salary
step for the position class Child Welfare Aide.
q. Board of delinquent children in private homes
or institutions in lieu of training schools or deten-
tion homes (§ 16.1-202 and § 63-293).
r. Reimbursement for cost of construction, main-
tenance and operation of detention homes (§ 63-
293.1 and § 16.1-201).

No salaries, fees or expenses shall be paid to any
officers out of this appropriation in cases where the
Compensation Board is required to fix and ascertain
same or any part thereof, until after certification by
the chairman of the Compensation Board to the State
Comptroller of the amounts of the salaries, if any,
and expense allowances of such officers fixed and
ascertained by said Board.
No part of this appropriation shall be used for the
payment of criminal charges incident to prisoners
employed at any State penal institution.
