An Act to amend and reenact §§ 638-5.2, 68-10, 68-26, 638-88, 68-89,
68-46, 638-78 as amended, and 68-79 of the Code of Virginia, relating
to the establishment and operation of stores in certain institutions
of the Department of Welfare and Institutions; employment of
agents and employees by the Director thereof; establishment of
personal entrance and performance standards by the State Board
of Welfare and Institutions; and the powers and duties of the Dv
rector; and to repeal §§ 63-5.1 and 68-47 of the Code of Virginia
relating to certain powers and duties of the Director of such De-
partment.

Be it enacted by the General Assembly of Virginia:
1. That §§ 63-5.2, 63-10, 63-26, 63-38, 63-39, 63-46, 63-78 as amended,
and 63-79 of the Code of Virginia be amended and reenacted as follows:
§ 63-5.2. Establishment and operation of stores in certain institu-
tions.—The Director of the Department of Welfare and Institutions is
hereby authorized to provide for the establishment and operation of
stores or commissaries in the institutions under his supervision to deal
in such articles as he shall deem proper. The net profits from the
operation of such stores shall be used within each institution respec-
tively for educational, recreational or other beneficial purposes as may
be prescribed by the Director.
Any such stores or commissaries heretofore established are hereby
continued and shall be operated in accordance with the preceding para-
graph. .
§ 63-10. Employment of agents and employees.—The Director may,
subject to the provisions of Chapter 10 of Title 2.1, engage or authorize
the engagement of such agents and employees as may be needed by the
Director and the Department in the exercise of the functions, duties and
powers conferred and imposed by law upon him and the Department,
and in order to effect a proper organization and to carry out its duties.
§ 63-26. Establishment of standards of service and personnel.—
The Board shall establish minimum entrance and performance standards
* for the personnel employed by the Commissioner, local boards and local
superintendents in the administration of the succeeding chapters of this
title and make necessary rules and regulations to maintain such entrance
and performance standards, including such rules and regulations as may
be embraced in the development of a system of personnel administration
meeting requirements of the * Federal Department of Health, Educa-
tion and Welfare under appropriate federal legislation relating to pro-
grams administered by the Board.
63-38. Powers and duties under this title—In addition to the
functions, duties and powers conferred and imposed upon the Director
by other provisions of law, he shall, in his capacity as Commissioner
of Public Welfare and, subject to the rules and regulations of the State
Board, have the powers and perform the duties conferred or imposed
upon him in this title. He shall, unless otherwise specified, see that the
provisions of this title are properly administered and shall enforce the
rules and regulations adopted by the State Board.
§ 63-39. Cooperation with local authorities—The Commissioner
shall assist and cooperate with local authorities in the administration
of this title. He shall encourage and direct the training of prospective
county or city superintendents of public welfare, all personnel of local
agencies engaged in the administration of any program within the
purview of this title, Title 58 or Chapter 8 of Title 16.1 of this Code.
The Commissioner shall collect and publish statistics regarding the de-
pendent, * and delinquent classes, both in and out of institutions,
within the State, and such other data as may be deemed of value in
assisting the public authorities and other social agencies of the State in
improving the care of these * persons and in correcting conditions that
contribute to * dependency and delinquency. The Commissioner shall
also, in his discretion, initiate and conduct conferences designed to
accomplish such ends and to further coordination of effort in this field.
§ 63-46. Standards for personnel.—The Commissioner shall enforce
the entrance and performance standards established by the State Board
for personnel employed in the administration of this title and remove *
each employee who does not meet such standards.
2. That §§ 63-5.1 and 63-47 of the Code of Virginia are repealed.
