An Act to amend Chapter 447 of the Acts of Assembly of 1962, approved
March 31, 1962, which provided a charter for the town of Rocky
Mount, in Franklin County, by adding a section numbered 28-a, so
as to provide that members of council and others shall not deal with
the town in certain matters; exceptions. rH 100]

Be it enacted by the General Assembly of Virginia:
1. That Chapter 447 of the Acts of Assembly of 1962, approved March
31, 1962, be amended by adding a section numbered 23-a, as follows:
23-a. No member of the council, mayor, or other officer, or em-
ployee of the town shall be interested directly or indirectly in the profits
of any contract or work, or be financially interested directly or indi-
rectly in the sale to the town of any land, materials, supplies, or services
(other than official services). Provided, however, the prohibitions of this
paragraph shall not apply to the purchase of materials, supplies, or
services from a member of the council, mayor or employee of the town of
Rocky Mount if the purchase of such is the result of the said town having
advertised for and secured sealed bids for such purchases, and if such be
the case any member of the council, mayor, or employee of the said town
may submit a bid for such purchases and the said town may thereafter
accept any such bid from any member of the council, mayor, or employee
of the said town in accordance with their regular procedure for accepting
such bids, provided, however, such bid shall only be accepted after a
unanimous vote of all the members of the council, and provided further,
however, the prohibitions of this paragraph shall not apply to the pur-
chase of any item of materials, supplies, or services from a member of
said council, mayor, or employee of the town of Rocky Mount provided
that the cost of any such purchase by the said town from any member of
the council, mayor, or employee of the town does not exceed the sum of
one hundred dollars, and provided further, any such purchase shall be
approved, confirmed or ratified by a unanimous vote of the council.
2. An emergency exists and this act is in force from its passage.
