An Act to amend the Code of Virginia by adding in Title 28 thereof a
chapter numbered 18.1, including §§ 28-174.1 through 238-174.9, re-
lating to Norfolk State College. $ 871]

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding in Title 23 thereof
a chapter numbered 13.1, including §§ 23-174.1 through 23-174.9 as fol-
lows:
Chapter 13.1
Norfolk State College
§ 23-174.1. There is hereby established a corporation composed of
the Board of Visitors of Norfolk State College under the style of “The
Visitors of Norfolk State College’, and which at all times shall be under
the control of the General Assembly.
§ 23-174.2. The corporation is formed for the purpose of establish-
ng and maintaining a college in the name and style of “Norfolk State
ollege”’.
§ 28-174.8. Upon the effective date of this act all real estate and
personal property existing and standing in the name of the visitors of
Virginia State College, situate or located in the city of Norfolk and util-
ized in connection with the Norfolk Division of Virginia State College,
shall be transferred to and be known and taken as standing in the
name, and to be under the control, of the visitors of Norfolk State College.
Such real estate and personal property shall be the property of the Com-
monwealth.
§ 23-174.4. (a) The Board of Visitors shall consist of eleven mem-
bers to be appointed by the Governor.
As soon as practicable after the effective date of this act, the
Governor shall appoint for terms to commence as of the date of appoint-
ment five members for two years terms and six members for four year
terms. Successors to the members so appointed shall be appointed to
serve for terms of four years each. Vacancies occurring other than by
expiration of term shall be filled for the unexpired term.
(c) All appointments shall be subject to confirmation by the General
Assembly. Members shall continue to hold office until their successors
have been appointed and qualified. Members shall be eligible for two
consecutive terms of four years, (exclusive of that portion of any term
on the initial Board of less than four years or any unexpired term).
§ 23-174.5. The Board shall be vested with all the rights and powers
conferred by the provisions of this chapter and the provisions relating
to similar corporations under the laws of this State so far as they are
applicable. The corporation shall also have the power to take, hold, re-
ceive and enjoy any gift, grant, devise or bequest to Norfolk State College,
the same to be held for the uses and purposes designated by the donor,
if any, or if not so designated, for the general purposes of the corporation.
§ 23-174.6. The Board shall control and expend the funds of the
corporation and any appropriation hereafter provided, and shall make all
necessary rules and regulations concerning the college, appoint a presi-
dent, who shall be its chief executive officer, and make all provisions for
teachers, staff members and agents, and shall fix their salaries and shall
prescribe their duties.
§ 23-174.7. The Board shall have the right to confer degrees, and
may fix the rates charged the students of the college for tuition, fees and
other necessary charges.
§ 23-174.8. Upon the effective date of this act, any appropriation
heretofore made to Virginia State College for utilization in connection
with the Norfolk Division, and then unexpended, shall be transferred to
the Visitors of Norfolk State College to be expended by the Board to
effectuate the purposes of this Act.
§ 23-174.9. This act shall become effective on a date set by the
Governor in a writing certifying to the Secretary of the Commonwealth that
he is dere the College will meet accreditation standards as a separate
institution.
