An Act to amend and reenact § 51-28.3 of the Code of Virginia, relating
to survivor benefits for widows of certain judges. S165)

Be it enacted by the General Assembly of Virginia:
1. That § 51-28.3 of the Code of Virginia be amended and reenacted
as follows:
§ 51-28.3. The widow of any judge who died in office after July one,
nineteen hundred sixty-four but prior to January one, nineteen hundred
sixty- * seven, and who had attained the age of sixty- * two years and
served for not less than twenty consecutive years as judge of any circuit
court, or of any corporation or city court of a city of the first class shall
be paid, * so long as she shall remain the widow of such judge, in the same
manner as the retirement salary, a survivor annuity equal to and computed
on the basis of one-half of that to which she would have been entitled
had such judge been eligible for retirement at the date of his death, such
annuity commencing the day after his death. Provided, however, that
nothing herein contained shall in any way affect the terms or amount of
any survivor annuity being paid to the widow of any judge prior to the
effective date hereof.
An emergency exists and this act is in force from its present passage.
