An Act for the relief of Paul C. Simpson, Sr.

Whereas, Paul C. Simpson, Sr., owns and operates a farm located in
Pulaski County, Virginia, and among other things raises raspberries and
tomatoes; and
Whereas, the Virginia Department of Agriculture and Commerce
on May 5, 1967, was spraying the adjoining property owned by L. V.
Linkous in an effort to control musk thistle; and
Whereas, in carrying out the spraying operations, the employees of
the Department of Agriculture and Commerce negligently allowed the
spray to be carried by wind drifts onto the property of Mr. Paul C.
Simpson, Sr., and cause damage to his raspberry and tomato crop to the
extent of $900.00; and
Whereas, the only remedy available to Paul C. Simpson, Sr., lies at
the hands of the General Assembly of Virginia; now, therefore,
Be it enacted by the General Assembly of Virginia:
1. § 1. There is hereby appropriated from funds available for the
Regulatory Division of the Virginia Department of Agriculture and Com-
merce the sum of nine hundred dollars to be paid by the State Treasurer
on warrant of the Comptroller issued upon vouchers signed by the Com-
missioner of the Virginia Department of Agriculture and Commerce to
Paul C. Simpson, Sr., upon execution by him of a release of all claims he
may have against the Commonwealth or any employees thereof in con-
nection with, or arising out of, the aforesaid negligence.
2. An emergency exists and this act is in force from its passage.
